                   A  BILL  FOR  AN  ACT
RELATING TO THE UNIVERSITY OF HAWAII.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 304-4, Hawaii Revised Statutes, is
 
 2 amended by amending subsection (c) to read as follows:
 
 3      "(c)  The board shall adopt the necessary rules defining
 
 4 residence for tuition purposes herein; provided that the basic
 
 5 rule shall be that a student shall qualify for the resident
 
 6 tuition fee only if the following criteria are met:
 
 7      (1)  The adult student, or in the case of a minor student,
 
 8           the student's parents or guardians, has been a bona
 
 9           fide resident of this State for at least twelve
 
10           consecutive months next preceding the student's first
 
11           day of officially scheduled instruction for any
 
12           semester or term in which the student is enrolling at
 
13           the particular college or campus[; and], unless the
 
14           student is the child of divorced parents such that:
 
15           (A)  The student and the student's parents lived in the
 
16                State at the time of the divorce;
 
17           (B)  The non-custodial parent was obligated to pay
 
18                child support by the divorce decree; and
 
19           (C)  The non-custodial parent was required to pay for

 1                the student's higher education by the divorce
 
 2                decree; and
 
 3      (2)  The adult or minor student has not been claimed as a
 
 4           dependent for tax purposes for at least twelve months
 
 5           next preceding the student's first day of officially
 
 6           scheduled instruction for any semester or term in which
 
 7           the student is enrolling at the particular college or
 
 8           campus by the student's parents or guardians who are
 
 9           nonresidents of the State; provided that this provision
 
10           shall not apply in cases where the parent claiming the
 
11           student as a dependent is entitled to do so under a
 
12           child support order or agreement issued or entered into
 
13           in conjunction with a divorce proceeding or legal
 
14           separation agreement, and the other parent and the
 
15           student meet the criteria set forth in paragraph (1)."
 
16      SECTION 2.  Statutory material to be repealed is bracketed.
 
17 New statutory material is underscored.
 
18      SECTION 3.  This Act shall take effect upon its approval.
