                   A  BILL  FOR  AN  ACT

RELATING TO ATHLETIC CONTEST OFFICIALS. 


BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  The legislature finds that sports officials
 
 2 hired by the department of education should be treated as
 
 3 educational workers for the purpose of the law relating to
 
 4 assaults against educational workers.  Sports officials are
 
 5 placed in a situation where there is an increase in the
 
 6 possibility of being criminally assaulted from their officiating
 
 7 of sporting events.  The protection of sports officials is
 
 8 important to this community due to the amount of year-round
 
 9 sporting activities in this State which require officiating.
 
10      SECTION 2.  Section 707-711, Hawaii Revised Statutes, is
 
11 amended by amending subsection (1) to read as follows:
 
12      "(1)  A person commits the offense of assault in the second
 
13 degree if:
 
14      (a)  The person intentionally or knowingly causes
 
15           substantial bodily injury to another;
 
16      (b)  The person recklessly causes serious bodily injury to
 
17           another person;
 
18      (c)  The person intentionally or knowingly causes bodily
 
19           injury to a correctional worker, as defined in section

 1           710-1031(2), who is engaged in the performance of duty
 
 2           or who is within a correctional facility;
 
 3      (d)  The person intentionally or knowingly causes bodily
 
 4           injury to another person with a dangerous instrument;
 
 5           or
 
 6      (e)  The person intentionally or knowingly causes bodily
 
 7           injury to an educational worker who is engaged in the
 
 8           performance of duty or who is within an educational
 
 9           facility.  For the purposes of this section,
 
10           "educational worker" means any administrator,
 
11           specialist, counselor, teacher, or employee of the
 
12           department of education, or a person who is a volunteer
 
13           in a school program, activity, or function that is
 
14           established, sanctioned, or approved by the department
 
15           of education or a person hired by the department of
 
16           education on a contractual basis and engaged in
 
17           carrying out an [educational] education-related
 
18           function.
 
19      SECTION 3.  This Act shall not apply to any proceeding filed
 
20 before its effective date, but shall apply to any proceeding
 
21 filed after its effective date regardless of when the cause of
 
22 action arose.
 
23      SECTION 4.  Statutory material to be repealed is bracketed.
