DESCRIPTION:
Prohibits after July 31, 2000, any reference to the licensee's
social security number on a driver's license.  Requires the
director of transportation to implement a new system of assigning

                   A  BILL  FOR  AN  ACT

RELATING TO MOTOR VEHICLES. 


BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 286-109, Hawaii Revised Statutes, is
 
 2 amended to read as follows:
 
 3      "�286-109  General provision governing the issuance of
 
 4 licenses.  Upon payment of the required fee and upon
 
 5 demonstrating the ability to operate a certain category or
 
 6 categories of motor vehicles to the satisfaction of the examiner
 
 7 of drivers, an applicant for a driver's license shall be issued a
 
 8 single license of a design approved by the director of
 
 9 transportation upon which is made a notation of the category or
 
10 categories of motor vehicles the applicant may operate, any
 
11 restrictive provisions to which the license is subject, and,
 
12 where the license is issued to a person under twenty-one years of
 
13 age, a statement, in clearly legible print that shall contrast
 
14 with the other information appearing on the license, which
 
15 indicates the date on which the person will attain the age of
 
16 twenty-one years.
 
17      After July 31, 2000, no licenses issued or renewed under
 
18 this section shall include within its design a notation of the
 
19 applicant's social security number.  The director of

 1 transportation shall adopt rules and procedures, including an
 
 2 appropriate license design, that assign a unique identification
 
 3 number to all driver's licenses issued after July 31, 2000.
 
 4      Statutes of limitations and other provisions of this chapter
 
 5 notwithstanding, no driver's license or instruction permit shall
 
 6 be issued or renewed under this section, where the examiner of
 
 7 drivers is notified by the district judge, traffic violations
 
 8 bureaus of the district courts, or the judge of the circuit court
 
 9 that the applicant has failed to respond to a traffic citation or
 
10 summons for the violation of any traffic laws of a county, this
 
11 chapter or [chapters] chapter 286G, 287, 290, 291, or 291C, and
 
12 the same remains delinquent and outstanding, or the applicant,
 
13 having timely responded initially, has as of the time of the
 
14 application, failed to comply in full with all orders of the
 
15 court."
 
16      SECTION 2.  Section 286-238, Hawaii Revised Statutes, is
 
17 amended by amending subsection (a) to read as follows:
 
18      "(a)  The application for a commercial driver's license or
 
19 commercial driver's instruction permit shall include the
 
20 following with respect to the applicant:
 
21      (1)  The full name and current mailing, residential, and
 
22           business addresses;
 
23      (2)  A physical description including sex and height;

 1      (3)  Date of birth;
 
 2     [(4)  Social security number;
 
 3      (5)] (4) Signature;
 
 4     [(6)] (5) Color photograph;
 
 5     [(7)] (6) Certifications including those required by 49 Code
 
 6           of Federal Regulations, �383.71(a), except that this
 
 7           certification applies to both intrastate and interstate
 
 8           drivers; and
 
 9     [(8)] (7) Any other information required by section 286-111."
 
10      SECTION 3.  Section 286-239, Hawaii Revised Statutes, is
 
11 amended by amending subsection (a) to read as follows:
 
12      "(a)  The commercial driver's license shall be marked "CDL"
 
13 and, to the maximum extent practicable, shall be tamperproof and
 
14 include, but not be limited to, the following with respect to the
 
15 licensee:
 
16      (1)  The name and residence address;
 
17      (2)  A color photograph;
 
18      (3)  A physical description including sex and height;
 
19      (4)  Date of birth;
 
20     [(5)  Social security number;
 
21      (6)] (5) Signature;
 
22     [(7)] (6) The class or type of commercial motor vehicle or
 
23           vehicles which may be driven together with any

 1           endorsements or restrictions;
 
 2     [(8)] (7) The name of this State; and
 
 3     [(9)] (8) The issuance and expiration dates of the license."
 
 4      SECTION 4.  Statutory material to be repealed is bracketed.
 
 5 New statutory material is underscored.
 
 6      SECTION 5.  This Act shall take effect upon its approval.
