REPORT TITLE:
Conveyance Tax; Disbursement


DESCRIPTION:
Creates a revolving fund for homeless assistance; amends
conveyance tax law to allow 25% of conveyance tax revenues to be
paid into the rental housing trust fund and 25% into the homeless
assistance fund; appropriates $70,000 for capital improvements to
Barbers Point for ADA compliance and utilities installation.

                   A  BILL  FOR  AN  ACT

RELATING TO HOUSING.


BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Chapter 201G, Hawaii Revised Statutes, is
 
 2 amended by adding a new section to part IV to be appropriately
 
 3 designated and to read as follows:
 
 4      "201G-    Special fund for homeless assistance.  There is
 
 5 created a special fund for homeless assistance, to be
 
 6 administered by the corporation as a separate fund from any other
 
 7 fund under this chapter.  Any funds appropriated for the purpose
 
 8 of homeless assistance and all moneys paid into the fund under
 
 9 section 247-7 shall be used by the corporation for homeless
 
10 assistance programs under this part."
 
11      SECTION 2.  Section 247-7, Hawaii Revised Statutes, is
 
12 amended to read as follows:
 
13      "247-7 Disposition of taxes.  All taxes collected under
 
14 this chapter shall be paid into the state treasury to the credit
 
15 of the general fund of the State, to be used and expended for the
 
16 purposes for which the general fund was created and exists by
 
17 law; provided that of the taxes collected each fiscal year[,
 
18 twenty-five]:
 
19      (1)  Twenty-five per cent shall be paid into the rental
 
20           housing trust fund established by section 201G-432 [and

 1           twenty-five];
 
 2      (2)  Twenty-five per cent shall be paid into the special
 
 3           fund for homeless assistance established by section
 
 4           201G-  ; and
 
 5      (3)  Twenty-five per cent shall be paid into the natural
 
 6           area reserve fund established by section 195-9;
 
 7           provided that the funds paid into the natural area
 
 8           reserve fund shall be annually disbursed to the natural
 
 9           area partnership and forest stewardship programs by the
 
10           department of land and natural resources after joint
 
11           consultation with the forest stewardship committee and
 
12           the natural area reserves system commission."
 
13      SECTION 3.  There is appropriated out of the general
 
14 revenues of the State of Hawaii the sum of $70,000, or so much
 
15 thereof as may be necessary for fiscal year 1999-2000, for
 
16 capital improvements for the purposes of:
 
17      (1)  Making building 49 comply with the Americans With
 
18           Disabilities Act, including renovating bathrooms for
 
19           wheelchair accessibility and improving wheelchair
 
20           ramps; and 
 
21      (2)  Consulting services for site water and electric meters,
 
22           purchasing and installing meters, and installing water
 
23           and electric services for all four buildings;

 1 for the homeless shelter facilities on Barbers Point Naval Air
 
 2 Station.
 
 3      SECTION 4.  There is appropriated out of the special fund
 
 4 for homeless assistance the sum of $600,000 or so much thereof as
 
 5 may be necessary for fiscal year 1999-2000 for the purposes of
 
 6 providing homeless assistance pursuant to chapter 201G, part IV,
 
 7 Hawaii Revised Statutes; provided that no funds shall be
 
 8 appropriated for the operation of a homeless shelter or facility
 
 9 that is provided in conjunction with the department of
 
10 transportation.
 
11      SECTION 5.  The sums appropriated shall be expended by the
 
12 housing and community development corporation of Hawaii for the
 
13 purposes of this Act.
 
14      SECTION 6.  Statutory material to be repealed is bracketed.
 
15 New statutory material is underscored.
 
16      SECTION 7.  This Act shall take effect on June 30, 2099.
