DESCRIPTION:
Creates a special fund for homeless assistance.  Amends the
conveyance tax law to allow 25% of conveyance tax revenues to be
paid into the rental housing trust fund and 25% into the homeless
assistance fund, and 25% into the natural area reserve fund.
Appropriates funds for capital improvements to Barbers Point for
ADA compliance and utilities installation.  Appropriates funds

                   A  BILL  FOR  AN  ACT

RELATING TO HOUSING.


BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  The legislature finds that the State must do
 
 2 more to help Hawaii's homeless increase their stability in the
 
 3 health, housing, and social areas so that they may be able to
 
 4 obtain and retain permanent housing and maintain economic
 
 5 independence and self-sufficiency for the long-term.  It has been
 
 6 recognized and accepted that programs designed to assist homeless
 
 7 persons are more effective and efficient when carried out through
 
 8 a continuum of care.
 
 9      The purpose of this Act is to:
 
10      (1)  Create a special fund for homeless assistance to be
 
11           used for homeless assistance programs; 
 
12      (2)  Earmark twenty-five per cent of conveyance tax revenues
 
13           for the special fund for homeless assistance; and
 
14      (3)  Make appropriations for homeless shelter facilities and
 
15           homeless assistance.
 
16      SECTION 2.  Chapter 201G, Hawaii Revised Statutes, is
 
17 amended by adding a new section to part IV to be appropriately
 
18 designated and to read as follows:

 1      "�201G-    Special fund for homeless assistance.  There is
 
 2 created a special fund for homeless assistance, to be
 
 3 administered by the corporation as a separate fund from any other
 
 4 fund under this chapter.  Any funds appropriated for the purpose
 
 5 of homeless assistance and all moneys paid into the fund under
 
 6 section 247-7 shall be used by the corporation for homeless
 
 7 assistance programs under this part.
 
 8      For purposes of this section, "homeless assistance" means
 
 9 homeless shelters and health, housing, and social services aimed
 
10 at obtaining and retaining economic independence and self-
 
11 sufficiency."
 
12      SECTION 3.  Section 247-7, Hawaii Revised Statutes, is
 
13 amended to read as follows:
 
14      "�247-7 Disposition of taxes.  All taxes collected under
 
15 this chapter shall be paid into the state treasury to the credit
 
16 of the general fund of the State, to be used and expended for the
 
17 purposes for which the general fund was created and exists by
 
18 law; provided that of the taxes collected each fiscal year[,
 
19 twenty-five]:
 
20      (1)  Twenty-five per cent shall be paid into the rental
 
21           housing trust fund established by section 201G-432 [and
 
22           twenty-five];

 1      (2)  Twenty-five per cent shall be paid into the special
 
 2           fund for homeless assistance established by section
 
 3           201G-  ; and
 
 4      (3)  Twenty-five per cent shall be paid into the natural
 
 5           area reserve fund established by section 195-9;
 
 6           provided that the funds paid into the natural area
 
 7           reserve fund shall be annually disbursed to the natural
 
 8           area partnership and forest stewardship programs by the
 
 9           department of land and natural resources after joint
 
10           consultation with the forest stewardship committee and
 
11           the natural area reserves system commission."
 
12      SECTION 4.  There is appropriated out of the general
 
13 revenues of the State of Hawaii the sum of $1 or so much thereof
 
14 as may be necessary for fiscal year 1999-2000 for capital
 
15 improvements for the purposes of:
 
16      (1)  Making building 49 comply with the Americans With
 
17           Disabilities Act, including renovating bathrooms for
 
18           wheelchair accessibility and improving wheelchair
 
19           ramps; and 
 
20      (2)  Consulting services for site water and electric meters,
 
21           purchasing and installing meters, and installing water
 
22           and electric services for all four buildings;
 
23 for the homeless shelter facilities on Barbers Point Naval Air
 
24 Station.

 1      SECTION 5.  There is appropriated out of the special fund
 
 2 for homeless assistance the sum of $1 or so much thereof as may
 
 3 be necessary for fiscal year 1999-2000 for the purposes of
 
 4 providing homeless assistance pursuant to chapter 201G, part IV,
 
 5 Hawaii Revised Statutes; provided that no funds shall be
 
 6 appropriated for the operation of a homeless shelter or facility
 
 7 that is provided in conjunction with the department of
 
 8 transportation.
 
 9      SECTION 6.  The sums appropriated shall be expended by the
 
10 housing and community development corporation of Hawaii for the
 
11 purposes of this Act.
 
12      SECTION 7.  Statutory material to be repealed is bracketed.
 
13 New statutory material is underscored.
 
14      SECTION 8.  This Act shall take effect on June 30, 2099.
