                     HOUSE  RESOLUTION

  ESTABLISHING AND ADOPTING POLICIES GOVERNING THE LEGISLATIVE
   BROADCAST PROGRAM FOR THE HOUSE OF REPRESENTATIVES.


 1       WHEREAS, the Hawaii State Legislature, through the passage
 2   of Act 331, Session Laws of Hawaii 1989, embarked upon a
 3   program to increase public access to and participation in the
 4   legislative process through the utilization of new information
 5   technologies; and
 6   
 7       WHEREAS, Act 259, Session Laws of Hawaii 1994, and Act 5,
 8   Special Session Laws of Hawaii 1995, declared the Legislature's
 9   commitment to provide greater public access to legislative
10   proceedings via cable television; and 
11   
12       WHEREAS, Act 174, Session Laws of Hawaii 1996, established
13   the Joint Legislative Access Committee and, among other things,
14   required it to oversee the operations of the Legislative
15   Broadcast Program; and
16   
17       WHEREAS, the Legislature, through the passage of Act 373,
18   Session Laws of Hawaii 1997, statutorily established the
19   Legislative Broadcast Program, which is intended to encourage
20   public involvement in the legislative process; and
21   
22       WHEREAS, the Legislative Broadcast Program produces live
23   and tape-delayed video broadcasts of selected legislative
24   proceedings for cablecasting on public access channels, and is
25   intended to increase public access to and participation in the
26   legislative process; and
27   
28       WHEREAS, `Olelo: the Corporation for Community Television
29   continues to provide the Legislature with invaluable technical
30   and engineering support, programming time for cablecasts,
31   broadcast production television equipment, and preventive
32   maintenance, repair, and replacement as needed; and
33   
34       WHEREAS, a private broadcast production company is
35   currently contracted by the Legislature to produce all
36   broadcasts of legislative proceedings; now, therefore,
37   
38       BE IT RESOLVED by the House of Representatives of the
39   Twentieth Legislature of the State of Hawaii, Regular Session
40   1999, that policies governing the Legislative Broadcast Program
41   for the House of Representatives are established; and

 1       BE IT FURTHER RESOLVED that the following policies are
 2   adopted by the House of Representatives:
 3   
 4       (1)  Policy Responsibility 
 5   
 6            The content, selection, and editorial policies shall
 7            be administered by the Speaker of the House of
 8            Representatives on behalf of the State House of
 9            Representatives. `Olelo: The Corporation for Community
10            Television shall provide technical and engineering
11            support, programming time for cablecasts, broadcast
12            production television equipment, and preventive
13            maintenance, repair, and replacement as needed;
14   
15       (2)  Distribution
16   
17            Cablecast programming coverage shall be provided by
18            `Olelo: The Corporation for Community Television on
19            Oahu;  the Hawaii Interactive Television System;
20            Akaku:  Maui Community Television on Maui, Molokai,
21            and Lanai;  Ho'ike:  Kauai Community Television on
22            Kauai; and Na Leo `O Hawaii:  Hawaii Community
23            Television on Hawaii.  All bonafide news organizations
24            and educational institutions may utilize the
25            programming material and shall bear costs associated
26            with such programming.  Political or commercial uses
27            of the material are prohibited;

29       (3)  Programming Content

31            Programming shall include live cablecasts on Oahu and
32            tape-delayed cablecasts statewide.  All public
33            committee hearings, legislative sessions, and other
34            legislative activities shall be authorized for
35            programming and selected by the Speaker of the House
36            in consultation with the Vice Speaker, House Majority
37            Leader, and the House Minority Leader.  Cablecasts of
38            legislative proceedings shall be covered gavel-to-
39            gavel, and shall include coverage of the speaker
40            recognized by the chair or presiding officer.
41            Occasional shots of the entire committee or assembled
42            body shall be allowed; however, close-up "reaction"
43            shots shall not be permitted.  Programming material
44            shall not be used for political or commercial
45            purposes;

 1       (4)  Ownership and Use of Programming
 2   
 3            Tapes and cablecasts shall be considered property of
 4            the House of Representatives and the Senate as
 5            appropriate.  Tapes and cablecasts shall not be
 6            considered an official record of the meeting, and
 7            there shall be no liability for inadvertent erasure or
 8            omission.  Tapes of proceedings shall be retained only
 9            for a period of time necessary to ensure rebroadcasts
10            on neighbor island cable systems, and for use in
11            program evaluation and staff training.  Duplication or
12            further distribution of tapes or cablecasts shall not
13            be permitted;
14   and
15   
16       BE IT FURTHER RESOLVED that certified copies of this
17   Resolution be transmitted to `Olelo:  The Corporation for
18   Community Television, Akaku:  Maui Community Television,
19   Ho'ike:  Kauai Community Television, Na Leo `O Hawaii:  Hawaii
20   Community Television, the University of Hawaii's Hawaii
21   Interactive Television System (HITS), Jones Spacelink, Sun
22   Cablevision, Kamehameha Cable, Hawaiian Cablevision, Chronicle
23   Cablevision, Oceanic Cablevision, Garden Isle Cablevision, and
24   Kauai Cablevision.
