                     HOUSE  RESOLUTION


REQUESTING THE ATTORNEY GENERAL TO REVIEW AND INTERPRET RELEVANT
   LAWS, AND ISSUE AN OPINION REGARDING THE CONSTITUTIONALITY
   OF ISSUING SPECIAL PURPOSE REVENUE BONDS TO EDUCATIONAL
   INSTITUTIONS THAT ARE AFFILIATED WITH SECTARIAN INTERESTS OR
   ORGANIZATIONS.



 1       WHEREAS, amendments to Article VII, Section 12, and Article
 2   X, Section 1, of the Hawaii State Constitution have been
 3   proposed in bill form at the Legislature to authorize the
 4   issuance of special purpose revenue bonds to private primary or
 5   secondary educational institutions; and
 6   
 7       WHEREAS, some private primary or secondary educational
 8   institutions are supported or associated with sectarian
 9   interests or organizations; and
10   
11       WHEREAS, the issuance of these special purpose revenue
12   bonds may raise issues under both the Establishment Clause and
13   the Free Exercise Clause of the First Amendment to the United
14   States Constitution and its counterpart in the Hawaii State
15   Constitution; and
16   
17       WHEREAS, the Legislature desires to be fully advised in
18   such constitutional issues before making a final decision on
19   such measures; now, therefore,
20   
21       BE IT RESOLVED by the House of Representatives of the
22   Twentieth Legislature of the State of Hawaii, Regular Session
23   of 1999, that the Attorney General is requested to review and
24   interpret relevant laws, and issue an opinion regarding the
25   constitutionality for the State to issue special purpose
26   revenue bonds to private primary or secondary educational
27   institutions that are affiliated with sectarian interests or
28   organizations; and
29   
30       BE IT FURTHER RESOLVED that the Attorney General transmit
31   the opinion to the Legislature no later than April 26, 1999;

 1       BE IT FURTHER RESOLVED that a certified copy of this
 2   Resolution be transmitted to the Attorney General.
