                     HOUSE RESOLUTION
REQUESTING THE DEPARTMENT OF HUMAN SERVICES TO CONDUCT A STUDY ON
   EXISTING GROUP LIVING FACILITIES.



 1       WHEREAS, group living facilities are facilities that are
 2   used to provide living accommodations and, in some cases, care
 3   services; and
 4   
 5       WHEREAS, group living facilities include:
 6   
 7       (1)  Facilities that are used to provide living
 8            accommodations and care services under a residential
 9            setting to individuals who are handicapped, aged,
10            disabled, or undergoing rehabilitation, and are
11            typically identified as group homes, halfway homes,
12            homes for children, the elderly, battered children and
13            adults, recovery homes, independent group living
14            facilities, hospices, and other similar facilities;
15   
16       (2)  Facilities that provide services, including hospital
17            care, and are typically identified as convalescent
18            homes, nursing homes, sanitariums, intermediate-care
19            or extended-care facilities, and other similar
20            facilities; and
21   
22       (3)  Living facilities with accommodations for more than
23            five resident individuals, except those meeting the
24            definition of family;
25   
26   and
27   
28       WHEREAS, for purposes of this Resolution, "family" means:
29   
30       (1)  One or more persons, all related by blood, adoption,
31            or marriage, who occupy a dwelling or lodging unit;
32   
33       (2)  No more than five unrelated persons who occupy a
34            dwelling or lodging unit; or
35   
36       (3)  Eight or fewer persons, who reside in an adult
37            residential care home, a special treatment facility,
38            or other similar facility, not including resident

 1            managers or supervisors in the count, monitored or
 2            licensed by the State;
 3   
 4   and
 5   
 6       WHEREAS, group living facilities are an important and
 7   necessary service for a number of Hawaii's citizens; and
 8   
 9       WHEREAS, group living facilities continue to proliferate
10   throughout the State to meet the needs of Hawaii's citizens;
11   and
12   
13       WHEREAS, it is therefore essential to ensure that group
14   living facilities are integrated into their respective
15   neighborhoods and communities on an orderly basis so as to
16   provide balance; now, therefore,
17   
18       BE IT RESOLVED by the House of Representatives of the
19   Twentieth Legislature of the State of Hawaii, Regular Session
20   of 1999, that the Department of Human Services is requested to
21   conduct a study to determine the number, location, status, and
22   needs of all existing group living facilities, as described
23   above, and whether any two group living facilities are within
24   1,000 feet of each other; and
25   
26       BE IT FURTHER RESOLVED that the Department of Human
27   Services is requested to report its findings to the Legislature
28   no later than twenty days prior to the convening of the Regular
29   Session of 2000; and
30   
31       BE IT FURTHER RESOLVED that a certified copy of this
32   Resolution be transmitted to the Director of Human Services.
