                     HOUSE CONCURRENT
                        RESOLUTION
  REQUESTING THE UNIVERSITY OF HAWAII TO CONVENE A STUDY GROUP TO
    CREATE A NEW HIGHER EDUCATION TITLE IN THE HAWAII REVISED
    STATUTES WHICH CLEARLY EXPRESSES LEGISLATIVE INTENT AND
    RECODIFIES THE HIGHER EDUCATION STATUTES.



 1        WHEREAS, the lower education statutes were recodified in
 2   1996, following the findings and recommendations of a study
 3   group convened in the previous year, in an effort to integrate
 4   recent education policy changes and communicate the intent and
 5   import of recent systemic reforms; and
 6   
 7        WHEREAS, in contrast to the policy changes affecting the
 8   Department of Education, the University of Hawaii has also
 9   recently undergone significant legislative reforms resulting in
10   increased fiscal and management autonomy; and
11   
12        WHEREAS, statutes relating to the University of Hawaii and
13   higher education presently span across several chapters in the
14   education title of the Hawaii Revised Statutes, as well as
15   various sections in chapters relating to state financial
16   administration and public contracts; and
17   
18        WHEREAS, a recodification of the higher education and
19   related statutes will further clarify the intent of the
20   Legislature to treat the University of Hawaii as an independent
21   and autonomous agency separate from other agencies in the state
22   administration; now, therefore,
23   
24        BE IT RESOLVED by the House of Representatives of the
25   Twentieth Legislature of the State of Hawaii, Regular Session
26   of 1999, the Senate concurring, that the University of Hawaii
27   is respectfully requested to convene a higher education
28   statutory recodification interim study group to identify and
29   submit to the 2000 Regular Session of the Legislature guiding
30   principles for statewide higher education policy which can be
31   adopted and used to evaluate future higher education
32   legislation; and
33   
34        BE IT FURTHER RESOLVED that the University of Hawaii is
35   requested to compose the study group so as to reflect the

 1   higher education community, including administrators, faculty,
 2   researchers, students, the President of the University of
 3   Hawaii or the President's representative, and the Chairperson
 4   of the Board of Regents of the University of Hawaii or the
 5   Chairperson's representative; and
 6   
 7        BE IT FURTHER RESOLVED that the study group, with the
 8   technical and legal assistance of the University's attorneys,
 9   is requested to develop an organizational framework to the
10   higher education chapters of title 18, Hawaii Revised Statutes,
11   including chapters 304, 305, 305A, 305E, 305H, 306, 307, 308,
12   309, and 310, Hawaii Revised Statutes, the various provisions
13   related to the University of Hawaii in the laws on state
14   financial administration and public property, purchasing and
15   contracting, in order to identify statutes which should be
16   consolidated, amended, or repealed for the purposes of
17   recodifying statutes relating to the University of Hawaii and
18   higher education; and
19   
20        BE IT FURTHER RESOLVED that the University of Hawaii is
21   respectfully requested to submit findings and recommendations,
22   including any proposed legislation developed by the study group
23   and the university's attorneys, to the Legislature twenty days
24   prior to the convening of the 2000 Regular Session; and
25   
26        BE IT FURTHER RESOLVED that certified copies of this
27   Concurrent Resolution be transmitted to the President of the
28   University of Hawaii and the Chairperson of the Board of
29   Regents of the University of Hawaii.
