                     HOUSE CONCURRENT
                        RESOLUTION
REQUESTING THE DEPARTMENT OF HEALTH TO EXAMINE THE IMPLICATIONS
   OF LEGALIZING PHYSICIAN-ASSISTED SUICIDE AND PHYSICIAN-
   ASSISTED DEATH.


 1       WHEREAS, H.B. No. 1155 (1999), Relating to Physician
 2   Assisted Death With Dignity, was intended to remove legal
 3   sanctions against physicians who help provide or administer
 4   lethal agents at the request of patients, under strictly
 5   defined conditions; and
 6   
 7       WHEREAS, the Department of Health (DOH) supported this
 8   measure, and testified that, "there are those few who, faced
 9   with intractable suffering or terminal illness and because
10   these and other improvements in the system will not be
11   sufficient, will choose to end their life.  For these few we
12   should carefully establish safeguards and provide the necessary
13   social and other support services recommended by the [Blue
14   Ribbon Panel on Living and Dying with Dignity]"; and
15   
16       WHEREAS, DOH also stated that "this measure ensures that
17   everything possible will be done to enhance the quality of life
18   of those few who choose to end their lives with dignity"; and
19   
20       WHEREAS, when asked if DOH has looked at projected outcomes
21   of moving the bill's direction, DOH responded by stating that
22   they have not done so; and
23   
24       WHEREAS, this measure was held in the House Committee on
25   Health because the implications for legalizing physician-
26   assisted suicide needs to be explored further; now, therefore,
27   
28       BE IT RESOLVED by the House of Representatives of the
29   Twentieth Legislature of the State of Hawaii, Regular Session
30   of 1999, the Senate concurring, that DOH is requested to
31   examine:

33       (1)  The impact of legalizing physician-assisted suicide
34            and physician-assisted death; and
35   
36       (2)  The implications of H.B. No. 1155 in greater detail;
37

 1       BE IT FURTHER RESOLVED that DOH submit its findings and
 2   recommendations to the Legislature no later than twenty days
 3   prior to the convening of the Regular Session of 2000; and
 4   
 5       BE IT FURTHER RESOLVED that a certified copy of this
 6   Concurrent Resolution be transmitted to the Director of Health.
