Agricultural Parks


DESCRIPTION:
Allows trusts and limited liability companies as applicants for
agricultural park leases.  Allows present lessees to transfer
their lease to a revocable living trust or other entity which
meets the qualification of an applicant under the chapter,
provided that the transfer is otherwise in compliance with the

                   A  BILL  FOR  AN  ACT

RELATING TO AGRICULTURAL PARK LEASES.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Chapter 166, Hawaii Revised Statutes, is amended
 
 2 by adding a new section to be appropriately designated and to
 
 3 read as follows:
 
 4      "166-    Lease transfers.  Persons who have been awarded a
 
 5 lease under this chapter may transfer the lease to their
 
 6 revocable living trust or other legal entity which meets the
 
 7 qualifications for an applicant under this chapter; provided that
 
 8 the transfer is otherwise in compliance with the rules adopted by
 
 9 the board for the purposes of this chapter."
 
10      SECTION 2.  Section 166-7, Hawaii Revised Statutes, is
 
11 amended to read as follows:
 
12      "166-7  Applicants.  A person, including [a] any revocable
 
13 living trust, partnership, corporation, limited liability
 
14 company, or association or an agricultural cooperative organized
 
15 under chapter 421 at least seventy-five per cent of the trustees,
 
16 partners, officers, and stockholders, or members of which qualify
 
17 individually, may apply for an agricultural park lease if the
 
18 person, trustees, partners, officers, and stockholders, or
 
19 members are eligible and qualified according to criteria set
 
20 forth in rules adopted by the board in conformance with section

 2      SECTION 3.  Statutory material to be repealed is bracketed.
 
 3 New statutory material is underscored.
