same.  Requires moneys donated on behalf of the UOH or a campus,

                   A  BILL  FOR  AN  ACT

RELATING TO DONATIONS OF MONEY TO PUBLIC EDUCATIONAL
   INSTITUTIONS.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Chapter 302A, Hawaii Revised Statutes, is
 
 2 amended by adding a new section to be appropriately designated
 
 3 and to read as follows:
 
 4      "�302A-     Donations of money.  (a)  The department may
 
 5 accept donations of money on behalf of the department or on
 
 6 behalf of individual departmental school districts, school
 
 7 complexes, and schools.
 
 8      (b)  Moneys donated on behalf of the department or on behalf
 
 9 of a departmental school district, school complex, or school
 
10 shall be deposited into insured checking or savings accounts and
 
11 shall be expended by the department or the departmental school
 
12 district, school complex, or school, respectively, pursuant to
 
13 rules adopted in accordance with chapter 91.  Notwithstanding any
 
14 other law to the contrary, all expenditures of money made under
 
15 this section shall be made by the organizational entity on whose
 
16 behalf the moneys were donated.
 
17      (c)  Expenditures of money from the insured checking and
 
18 savings accounts described in subsection (b) shall not be subject
 
19 to chapter 103D, notwithstanding section 103D-102 to the

 1 contrary.
 
 2      (d)  Nothing in this section or rules adopted pursuant to
 
 3 this section shall prevent the department or a departmental
 
 4 school district, school complex, or school from complying with
 
 5 the terms and conditions of any grant, gift, bequest, or
 
 6 cooperative agreement made pursuant to this section."
 
 7      SECTION 2.  Chapter 304, Hawaii Revised Statutes, is amended
 
 8 by adding a new section to be appropriately designated and to
 
 9 read as follows:
 
10      "�304-     Donations of money.  (a)  The University of
 
11 Hawaii may accept donations of money on behalf of the university
 
12 or on behalf of individual campuses, colleges, community
 
13 colleges, schools, departments, and organized research units.
 
14      (b)  Moneys donated on behalf of the university or on behalf
 
15 of a campus, college, community college, school, department, or
 
16 organized research unit shall be deposited into insured checking
 
17 or savings accounts and shall be expended by the university or
 
18 the campus, college, community college, school, department, or
 
19 organized research unit, respectively, pursuant to rules adopted
 
20 in accordance with chapter 91.  Notwithstanding any other law to
 
21 the contrary, all expenditures of money made under this section
 
22 shall be made by the organizational entity on whose behalf the
 
23 moneys were donated.

10      SECTION 3.  New statutory material is underscored.
 
11      SECTION 4.  This Act shall take effect on July 1, 1999.
