DESCRIPTION:
Increases from 60 to 65 feet, total overall length of truck-
tractor and semitrailer.  For certain other like vehicles,

                   A  BILL  FOR  AN  ACT

RELATING TO MOTOR VEHICLES.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 291-34, Hawaii Revised Statutes, is
 
 2 amended by amending subsection (c) to read as follows:
 
 3      "(c)  Length:
 
 4      (1)  No single motor vehicle or other power vehicle having a
 
 5           total overall length greater than forty-five feet,
 
 6           including load, shall be operated or moved upon any
 
 7           public road, street, or highway within the State,
 
 8           except as [hereinafter] provided[;] in this subsection.
 
 9      (2)  No truck-tractor and semitrailer having a total overall
 
10           length greater than [sixty] sixty-five feet, including
 
11           load, shall be operated or moved upon any public road,
 
12           street, or highway, other than interstate highways and
 
13           certain qualifying federal aid highways as designated
 
14           by the director of transportation, within the State,
 
15           except as [hereinafter] provided[;] in this subsection;
 
16           provided that [for]:
 
17           (A)  For truck-tractors and semitrailers used for
 
18                agricultural purposes, public utilities

 1                maintenance and service vehicles, or articulated
 
 2                buses for public transit purposes, the total
 
 3                combined length of the truck-tractor and
 
 4                semitrailer, public utility maintenance and
 
 5                service vehicle, or articulated bus shall not
 
 6                exceed sixty-five feet in length; [provided
 
 7                further that the] and
 
 8           (B)  The length of the semitrailer shall not exceed
 
 9                [forty-five] forty-eight feet in length;
 
10      (3)  No combination of motor vehicles or other power
 
11           vehicles coupled together shall consist of more than
 
12           two units and no such combination of vehicles having a
 
13           total overall length greater than sixty-five feet,
 
14           including load, shall be operated or moved upon any
 
15           public road, street, or highway other than interstate
 
16           highways and certain qualifying federal aid highways as
 
17           designated by the director of transportation, within
 
18           the State, except as [hereinafter] provided[.] in this
 
19           subsection.  A truck-tractor and semitrailer shall be
 
20           regarded as a single unit when determining the number
 
21           of units in a combination;
 
22      (4)  No motor vehicle, self-propelled construction or farm

 1           equipment, trailer, or semitrailer shall be operated
 
 2           upon any public road, street, or highway within the
 
 3           State if it is carrying or otherwise has projecting to
 
 4           the front or rear, a load, boom, mast, or other
 
 5           projecting structure or attachment unless:
 
 6           (A)  With respect to self-propelled construction or
 
 7                farm equipment:
 
 8                (i)  The length of the equipment measured on a
 
 9                     horizontal axis, including the projection, is
 
10                     not greater than forty-five feet;
 
11               (ii)  The projection is either held securely in
 
12                     place or is controlled by the driver or an
 
13                     operator;
 
14              (iii)  The projection does not obstruct the driver's
 
15                     vision;
 
16               (iv)  The projection does not impair the driver's
 
17                     ability to control the equipment;
 
18                (v)  The projection beyond the front tires is at
 
19                     least seven feet above the roadway surface;
 
20                     and
 
21               (vi)  The projection does not extend more than four
 
22                     feet past the extremity of the piece of

 1                     equipment, or if it extends more than four
 
 2                     feet, an escort vehicle is provided by the
 
 3                     owner or operator either to the front or to
 
 4                     the rear of the projection to call attention
 
 5                     to the projection; or
 
 6           (B)  With respect to a motor vehicle, or a motor
 
 7                vehicle with attached trailer or semitrailer:
 
 8                (i)  The overall length of a motor vehicle
 
 9                     including the projection, is not greater than
 
10                     forty-five feet or the overall length of the
 
11                     motor vehicle with attached trailer or
 
12                     semitrailer, including the projection, is not
 
13                     greater than sixty feet except that this
 
14                     limitation on a motor vehicle with attached
 
15                     trailer or semitrailer, including the
 
16                     projection, shall not be applicable on
 
17                     interstate highways and certain qualifying
 
18                     federal aid highways, as designated by the
 
19                     director of transportation;
 
20               (ii)  The projection is either held securely in
 
21                     place or is controlled by the driver or an
 
22                     operator;

 1              (iii)  The projection does not obstruct the driver's
 
 2                     vision;
 
 3               (iv)  The projection does not impair the driver's
 
 4                     ability to control the equipment;
 
 5                (v)  The projection beyond the front tires is at
 
 6                     least seven feet above the roadway surface;
 
 7                     and
 
 8               (vi)  The projection does not extend more than four
 
 9                     feet past the extremity of the trailer or
 
10                     semitrailer, or, if it extends more than four
 
11                     feet, an escort vehicle is provided by the
 
12                     owner or operator either to the front or to
 
13                     the rear of the projection to call attention
 
14                     to the projection;
 
15      (5)  The [foregoing] limitations in this subsection upon
 
16           length shall not apply to vehicles transporting pipe,
 
17           poles, timbers, reinforcing steel, structural steel, or
 
18           other objects of a structural nature which cannot be
 
19           readily dismembered; provided that when transported by
 
20           night every such vehicle shall be equipped with a
 
21           sufficient number of clearance lamps upon the extreme
 
22           ends of any projecting load to clearly mark the

 1           dimensions of the load."
 
 2      SECTION 2.  Statutory material to be repealed is bracketed.
 
 3 New statutory material is underscored.
 
 4      SECTION 3.  This Act shall take effect upon its approval.
