                   A  BILL  FOR  AN  ACT

RELATING TO THE OFFICE OF HAWAIIAN AFFAIRS BUDGET.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  The purpose of this Act is to appropriate funds
 
 2 for the biennial budget of the office of Hawaiian affairs.
 
 3      SECTION 2.  Unless otherwise clear from the context, as used
 
 4 in this Act:
 
 5      "Program ID" means the unique identifier for the specific
 
 6 program, and consists of the abbreviation for the office of
 
 7 Hawaiian affairs followed by a designated number for the program.
 
 8      "Means of Financing", or "MOF", means the source from which
 
 9 funds are appropriated or authorized, as the case may be, to be
 
10 expended for the programs and projects specified in this Act.
 
11 Letter symbols following appropriations have the following
 
12 meanings:
 
13      A:  General funds
 
14      T:  Trust funds
 
15      "Position ceiling" means the maximum number of permanent
 
16 positions authorized for a particular program during a specified
 
17 period or periods, as noted by an asterisk.
 
18      SECTION 3.  The following sums, or so much thereof as may be
 
19 necessary to accomplish the purposes and programs designated
 
20 herein, are appropriated or authorized, as the case may be, from

 1 the sources of funding specified to the office of Hawaiian
 
 2 affairs for the fiscal biennium beginning July 1, 1999, and
 
 3 ending June 30, 2001.  The total general fund expenditures and
 
 4 the number of permanent positions established in each fiscal year
 
 5 of the biennium shall not exceed the sums and the position
 
 6 ceiling indicated for each year, except as provided elsewhere in
 
 7 this Act.
 
 8      SECTION 4.  Provided that the general fund appropriations in
 
 9 section 3 of this Act shall be expended by the office of Hawaiian
 
10 affairs.
 
11      SECTION 5.  Provided that of the funds appropriated for
 
12 planning and research (OHA 104), the sum of $31,259 in general
 
13 funds and $31,258 in trust funds for fiscal year 1999-2000 shall
 
14 be used for the purpose of developing a comprehensive Hawaiian
 
15 master plan; provided further that any general funds not expended
 
16 for this purpose shall be lapsed to the general fund; and
 
17 provided further that the office of Hawaiian affairs shall submit
 
18 a report regarding the status of this master plan to the
 
19 legislature no less than twenty days prior to the convening of
 
20 the 2000 and 2001 regular sessions.
 
21      SECTION 6.  Provided that whenever the need arises, the
 
22 board of trustees for the office of Hawaiian affairs is
 
23 authorized to transfer sufficient funds and positions between

 1 programs for research and development and operating purposes;
 
 2 provided further that these transfers shall not be inconsistent
 
 3 with legislative intent; and provided further that a report shall
 
 4 be made to the legislature no later than twenty days prior to the
 
 5 convening of the 2000 and 2001 regular sessions.
 
 6      SECTION 7.  Provided that, except as otherwise appropriated
 
 7 or authorized, the office of Hawaiian affairs and the State of
 
 8 Hawaii shall share proportionately in the costs of wages and
 
 9 fringe benefits for employees of the office of Hawaiian affairs;
 
10 provided further that, for the purposes of this Act, "fringe
 
11 benefits" means benefits received by public employees, including
 
12 hospital, medical, and dental care under the public employees
 
13 health fund, and temporary disability insurance, workers'
 
14 compensation, social security, and retirement benefits.
 
15      SECTION 8.  In the event manifest clerical, typographical,
 
16 or other mechanical error are found in this Act, the board of
 
17 trustees is hereby authorized to correct such errors.  All
 
18 changes made pursuant to this section shall be reported to the
 
19 legislature at its next session.
 
20      SECTION 9.  This Act shall take effect on July 1, 1999.
