prohibited net fishing sites.

                   A  BILL  FOR  AN  ACT



 1      SECTION 1.  The legislature finds that conservation of the
 2 State's natural resources requires increased protection of fish
 3 life along the shorelines of the State.  Without such protection
 4 the delicate ecosystem of the waters may be jeopardized.  The
 5 legislature previously determined that certain sites such as
 6 Honolulu harbor and Hilo harbor merited protection from unlimited
 7 fishing activity.
 8      The purpose of this Act is to include all commercial harbors
 9 in the State of Hawaii under the umbrella of protection afforded
10 by the previous legislation.
11      SECTION 2.  Section 188-34, Hawaii Revised Statutes, is
12 amended to read as follows:
13      "188-34  Fishing in Honolulu harbor, Hilo harbor,
14 Nawiliwili harbor, Port Allen harbor, and Kahului harbor
15 restricted.  It is unlawful to take or kill fish by means of any
16 draw, drag, or seine net in the waters of the harbor of Honolulu;
17 provided that commercial marine licensees as defined in chapter
18 187A may take bait fish by means of any draw, drag, or seine net
19 during periods scheduled by the harbor master.

 1      It is unlawful to take or kill fish by means of any net in
 2 the waters of [that]:
 3      (1)  That portion of the bay of Hilo bounded by the
 4           breakwater, a line from the outer end of the breakwater
 5           to Alealea Point, and the shoreline from Alealea Point
 6           to the inshore end of the breakwater[,];
 7      (2)  Nawiliwili harbor;
 8      (3)  Port Allen harbor; and
 9      (4)  Kahului harbor;
10 provided that commercial marine and pond operators with
11 appropriate licenses issued by the department of land and natural
12 resources may take bait fish or pua, or persons may use throw
13 net, opae net, crab net, or nehu net not longer than fifty feet
14 to take nehu for family consumption or bait purposes."
15      SECTION 3.  Statutory material to be repealed is bracketed.
16 New statutory material is underscored.
17      SECTION 4.  This Act shall take effect upon its approval.
