with comparable authority over irrigation water as the county
water supply agencies exercise over water for municipal purposes;
provides same authority to Agribusiness Development Corporation

                   A  BILL  FOR  AN  ACT

RELATING TO THE STATE WATER CODE.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  The legislature finds that the board of
 
 2 agriculture's authority over irrigation water under the state
 
 3 water code should be comparable to the authority exercised by the
 
 4 county water agencies over water for municipal purposes.  Since
 
 5 both systems provide for the public's health and welfare, both
 
 6 systems should stand on equal footing with one another.  The
 
 7 purposes of this Act are to provide the board of agriculture with
 
 8 the same authority over the water it purveys, under chapters 167
 
 9 and 168, Hawaii Revised Statutes (HRS), as the county water
 
10 supply agencies exercise over the water that they purvey, and to
 
11 extend the same authority to the agribusiness development
 
12 corporation under chapter 163D, HRS.
 
13      SECTION 2.  Section 174C-48, Hawaii Revised Statutes, is
 
14 amended by amending subsection (b) to read as follows:
 
15      "(b)  In its regulation of water resources in designated
 
16 water management areas, the commission shall delegate to the
 
17 [county boards of water supply]:
 
18      (1)  County water supply agencies the authority to allocate
 
19           the use of water for municipal purposes, subject to the

 1           limits of water supply allocated to the county [boards
 
 2           of water supply] water supply agencies in their role as
 
 3           water purveyors[.];
 
 4      (2)  Board of agriculture the authority to allocate the use
 
 5           of water for agricultural irrigation purposes, subject
 
 6           to the limits of water supply allocated to the board of
 
 7           agriculture in its role as irrigation water purveyor
 
 8           under chapters 167 and 168; and
 
 9      (3)  Agribusiness development corporation the authority to
 
10           allocate the use of water for agricultural irrigation
 
11           purposes, subject to the limits of water supply
 
12           allocated to the agribusiness development corporation
 
13           in its role as irrigation water purveyor under
 
14           chapter 163D."
 
15      SECTION 3.  Statutory material to be repealed is bracketed.
 
16 New statutory material is underscored.
 
17      SECTION 4.  This Act shall take effect upon its approval.
