Requires that medical directors of managed care health plans be
licensed to practice medicine in Hawaii.  Prohibits sale of laser
pointers to minors and possession by minors. (SD1)

                   A  BILL  FOR  AN  ACT



 1      SECTION 1.  The Hawaii Revised Statutes is amended by adding
 2 a new chapter to be appropriately designated and to read as
 3 follows:
 4                             "CHAPTER
 5                      LASER POINTING DEVICES
 6         -1  Definitions.  As used in this chapter, "laser
 7 pointing device" means a hand-held device that emits a light beam
 8 amplified by the stimulated emission of radiation that is visible
 9 to the human eye.
10         -2  Harrassment; prohibited.  No person eighteen years
11 of age or over shall intentionally focus, point, or shine a laser
12 pointing device directly or indirectly into the eye or eyes of
13 another person, or upon another person or animal, in such a
14 manner as would reasonably be expected to annoy, harass, or alarm
15 the person or animal.
16         -3  Sale to minors; prohibited.  It shall be unlawful to
17 sell or furnish a laser pointing device to any person under
18 eighteen years of age.
19         -4  Disclosure.  No person shall sell a laser pointing

 1 device without providing to the buyer at the time of sale a
 2 written warning explaining the dangers of the improper usage of
 3 the device.
 4         -5  Possession of laser pointing devices by minors
 5 prohibited.  It shall be unlawful for any minor to possess a
 6 laser pointing device.
 7         -6  Penalties.(a)  Any violation of section    -2 is
 8 punishable by a fine of not more than $1,000 and imprisonment for
 9 a definite term to be fixed by the court not to exceed thirty
10 days.
11      (b)  Any violation of section    -3,    -4, or    -5 is
12 punishable by a fine of not more than $1,000."
13      SECTION 2.  Chapter 432E, Hawaii Revised Statutes, is
14 amended by adding a new section to be appropriately designated
15 and to read as follows:
16      "432E-     Licensure of managed care plan medical
17 directors.  The medical director of any managed care plan
18 providing services in the State shall hold an unlimited license
19 to practice medicine in the State pursuant to chapter 453 or
20 460."
21      SECTION 3.  Section 432E-1, Hawaii Revised Statutes, is
22 amended by adding a new definition to be appropriately inserted
23 and to read as follows:

 1      ""Medical director" means the person who is authorized under
 2 a managed care plan and who makes the final decision for the plan
 3 denying or allowing requests for medical treatments, services, or
 4 supplies based on medical necessity or other appropriate medical
 5 or health plan benefit standards."
 6      SECTION 4.  New statutory material is underscored.
 7      SECTION 5.  This Act shall take effect upon its approval;
 8 provided that section    -4 of section 1 shall take effect on
 9 January 1, 2000.
