                   A  BILL  FOR  AN  ACT

RELATING TO THE HAWAII PENAL CODE.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Chapter 708, Hawaii Revised Statutes, is amended
 
 2 by adding a new section to part IV to be appropriately designated
 
 3 and to read as follows:
 
 4      "�708-     Ticket scalping.  (1)  As used in this section,
 
 5 "event" means a musical concert or an athletic or sporting event
 
 6 to which the general public is admitted.
 
 7      (2)  No person:
 
 8      (a)  Shall issue or sell a ticket to an event without
 
 9           printing on the ticket in a conspicuous place the price
 
10           of the ticket and the seat number, if any;
 
11      (b)  Shall charge for admission to an event a price greater
 
12           than the price advertised or stated on tickets issued
 
13           for the event;
 
14      (c)  Shall sell, or offer to sell, a ticket to an event at a
 
15           price greater than the price charged at the place of
 
16           admission or printed on the ticket;
 
17      (d)  After having received a ticket to an event, shall sell,
 
18           or offer to sell, the ticket in violation of conditions
 
19           restricting the ticket's transfer; or

 1      (e)  Being in control of premises on or in which an event is
 
 2           held, shall permit the sale, or exhibition for sale, on
 
 3           or in the premises, of a ticket to the event at a price
 
 4           greater than the price printed on the ticket.
 
 5      (3)  Any person who violates this section shall be guilty of
 
 6 a misdemeanor.
 
 7      (4)  This section shall not apply to the charging of a fee
 
 8 for services rendered in connection with the sale of a ticket to
 
 9 an event, if the fee is permitted pursuant to a contract between
 
10 the ticket seller and the promoter of the event."
 
11      SECTION 2.  This Act does not affect rights and duties that
 
12 matured, penalties that were incurred, and proceedings that were
 
13 begun, before its effective date.
 
14      SECTION 3.  New statutory material is underscored.
 
15      SECTION 4.  This Act shall take effect upon its approval.
