Agency on child support payments to be used to pay penalties to
custodial parents for late payments and to make a certain

                   A  BILL  FOR  AN  ACT

RELATING TO CHILD SUPPORT ENFORCEMENT. 


BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 576D-10, Hawaii Revised Statutes, is
 
 2 amended by amending subsection (a) to read as follows:
 
 3      "(a)  The agency shall collect and disburse child support
 
 4 payments when an order requires the collection and disbursal.
 
 5 Notwithstanding any other law to the contrary, the agency shall
 
 6 maintain a special interest bearing account for child support
 
 7 payments.  Moneys collected by the agency for child support
 
 8 payments shall not be deposited into the state treasury, but
 
 9 shall be deposited into this account.  Moneys to be disbursed by
 
10 the agency for child support payments shall be disbursed from
 
11 this account without appropriation or allotment.  The interest
 
12 realized from this account shall be used [for related costs of
 
13 the maintenance and operation of the account and the]:
 
14      (1)  To pay penalties, as determined by the agency, to the
 
15           custodial parents for late payments made by the agency;
 
16           and
 
17      (2)  To improve client services by the agency; provided that
 
18           the amount used for this purpose shall be limited to

 1                percent of the available funds each year and shall
 
 2           be made available at the end of each fiscal year.
 
 3 The balance, if any, shall be deposited into the state treasury
 
 4 to the credit of the general fund."
 
 5      SECTION 2.  Statutory material to be repealed is bracketed.
 
 6 New statutory material is underscored.
 
 7      SECTION 3.  This Act shall take effect upon its approval.
