Pesticide Revolving Fund

Increase the limit on the Pesticides Revolving Fund to $600,000
and expands the uses thereof.

                   A  BILL  FOR  AN  ACT



 1      SECTION 1.  Section 149A, Hawaii Revised Statutes, is
 2 amended to read as follows:
 3      "[[]149A-13.5[]]  Pesticide use revolving fund; pesticide
 4 training workshops; training fee.(a)  There is established
 5 within the treasury of the State, a pesticide use revolving fund.
 6 The fund shall be administered by the department for the purposes
 7 of this section.  The fund shall consist of:
 8      (1)  Licensing and registration fees and charges collected
 9           by the department under section 149A-13(b); and
10      (2)  All fees collected by the department through the
11           collection of training fees in accordance with
12           subsection (c).
13      (b)  Moneys in the pesticide use revolving fund shall be
14 expended by the department [to support] for agricultural and
15 household use purposes, including supporting the pesticide
16 program's registration and licensing, certification and
17 education, and compliance monitoring activities.  The department
18 shall also expend revolving fund moneys on the establishment of
19 pesticide training workshops, educational programs, and other

 1 services for pesticide users such as the agricultural pest
 2 control industry, the structural pest control industry, and
 3 consumer users of pesticides, which provide pesticide instruction
 4 in areas, including but not limited to, the collection, disposal,
 5 and recycling of pesticide containers and all other pesticide
 6 services deemed necessary by the department.  Moneys from the
 7 revolving fund may be used for the purchase of services,
 8 materials, and equipment.
 9      Moneys expended by the department from the pesticide use
10 revolving fund for training workshops, educational programs, and
11 other services for the agricultural pest control industry, the
12 structural pest control industry, and consumer groups shall be
13 done so in a manner that appropriately addresses the needs of
14 each category of pesticide user.
15      (c)  The department may set fees for the educational
16 services and training provided under this section. 
17      (d)  All interest earned on the deposit or investment of the
18 moneys in the fund shall become a part of the fund.
19      (e)  The balance in the revolving fund shall not exceed
20 [$250,000.] $600,000.  All amounts in excess of the [$250,000]
21 $600,000 shall be deposited to the credit of the state general
22 fund."
23      SECTION 2.  Statutory material to be repealed is bracketed.
