                   A  BILL  FOR  AN  ACT

RELATING TO TRAFFIC VIOLATIONS.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Chapter 291, Hawaii Revised Statutes, is amended
 
 2 by adding a new section to be appropriately designated and to
 
 3 read as follows:
 
 4      "�291-    Aggressive driving; penalty.  (a)  Whoever
 
 5 operates any vehicle within the State of Hawaii in a manner or at
 
 6 a speed which endangers or is likely to endanger the safety of
 
 7 persons or property is guilty of aggressive driving and shall be
 
 8 fined not more than $1,000, or imprisoned not more than forty-
 
 9 eight hours, or both.
 
10      (b)  "Aggressive driving" means the commission of any two or
 
11 more infractions in a single act or series of acts within close
 
12 proximity to another vehicle including but not limited to the
 
13 unsafe changing of lanes, following too closely, failing to
 
14 signal while changing lanes, failing to yield, speeding, driving
 
15 too fast for existing conditions, and driving on the shoulder of
 
16 the roadway."
 
17      SECTION 2.  This Act does not affect rights and duties that
 
18 matured, penalties that were incurred, and proceedings that were
 
19 begun, before its effective date.
