                   A  BILL  FOR  AN  ACT

RELATING TO FIREWORKS.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 132D-7, Hawaii Revised Statutes, is
 
 2 amended to read as follows:
 
 3      "[[]132D-7[]]  License or permit required.(a)  It shall
 
 4 be unlawful for any person to import any fireworks into the
 
 5 State, to store, offer to sell or sell, at wholesale or retail
 
 6 any fireworks, unless the person has a valid license issued by
 
 7 the department.
 
 8      (b)  It shall be unlawful for any person to set off, ignite
 
 9 or discharge aerial common or special fireworks at any time or to
 
10 set off, ignite or discharge non-aerial common fireworks at any
 
11 time other than the periods for use prescribed in section
 
12 132D-3(1) in any county unless the person [has] is issued a valid
 
13 permit [issued] by the county in which the permitted activity is
 
14 to occur[.] at least forty-eight hours before the permitted
 
15 activity.
 
16      (c)  Any aerial common fireworks confiscated as contraband
 
17 under subsection (b) shall be seized and disposed of."
 
18      SECTION 2.  Statutory material to be repealed is bracketed.
 
19 New statutory material is underscored.
