                   A  BILL  FOR  AN  ACT

RELATING TO ACT 329, SESSION LAWS OF HAWAII 1997.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  In 1997, by enactment of Act 329, Session Laws
 
 2 of Hawaii, a two year process for resolving the controversy with
 
 3 respect to the proper management and disposition of the lands
 
 4 subject to the public land trust and the proceeds and income
 
 5 therefrom, and to effectuate article XII, section 6 of the Hawaii
 
 6 Constitution, was established.  The act reiterated the
 
 7 legislative purpose underlying the existing provisions of chapter
 
 8 10, Hawaii Revised Statutes, established a joint committee to
 
 9 gather information, facilitate discussion and secure
 
10 recommendations to address issues relating to the lands subject
 
11 to the public land trust that might benefit from further
 
12 legislative clarification of the existing laws, set out an
 
13 interim alternative means to continue providing the income and
 
14 proceeds of a pro rata portion of the public land trust to the
 
15 office of Hawaiian affairs while the issues in controversy are
 
16 addressed by the joint committee and the Legislature, and
 
17 directed that a comprehensive inventory and mapping of the public
 
18 trust lands be completed.
 
19      The two years allotted for the process has not been enough

 1 to complete Act 329's objectives.
 
 2      The purpose of this bill is to provide the means by which to
 
 3 continue the provisions contained in Act 329.
 
 4      SECTION 2.  Section 10-13.3, Hawaii Revised Statutes, is
 
 5 amended to read as follows:
 
 6      "�10-13.3  Interim revenue.  Notwithstanding the definition
 
 7 of revenue contained in this chapter and the provisions of
 
 8 section 10-13.5, and notwithstanding any claimed invalidity of
 
 9 Act 304, Session Laws of Hawaii 1990, the income and proceeds
 
10 from the pro rata portion of the public land trust under article
 
11 XII, section 6 of the state constitution for expenditure by the
 
12 office of Hawaiian affairs for the betterment of the conditions
 
13 of native Hawaiians for each of fiscal year 1997-1998, [and]
 
14 fiscal year 1998-1999, and fiscal year 1999-2000 shall be
 
15 $15,100,000."
 
16      SECTION 3.  Act 329, Session Laws of Hawaii 1997, is amended
 
17 by adding a new section to read as follows:
 
18      "SECTION 7A.  There is appropriated out of the general
 
19 revenues of the State of Hawaii the sum of $15,100,000 or so much
 
20 thereof as may be necessary for fiscal year 1999-2000 and
 
21 $15,100,000 or so much thereof as may be necessary for fiscal
 
22 year 2000-2001 to be transferred to and expended by the office of
 
23 Hawaiian affairs for the purposes of section 10-13.3, Hawaii
 
24 Revised Statutes."
 
25      SECTION 4.  Statutory material to be repealed is bracketed.
