                   A  BILL  FOR  AN  ACT

RELATING TO THE REVIEW OF THE SALARIES OF THE TRUSTEES OF THE
   OFFICE OF HAWAIIAN AFFAIRS.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Act 358, Session Laws of Hawaii 1993,
 
 2 established a process for the periodic review of the salaries of
 
 3 the trustees of the office of Hawaiian affairs.  Beginning in
 
 4 1996, and in four-year increments thereafter, the governor was
 
 5 directed to appoint members to a salary review commission on or
 
 6 before November 30.  By the fortieth legislative day of the next
 
 7 regular legislative session, the salary review commission was
 
 8 directed to submit its recommendations for any salary adjustments
 
 9 to the legislature.  Through inadvertence, the initial salary
 
10 review commission was not appointed and the four-year review
 
11 cycle was not initiated.
 
12      The purpose of this Act is to re-establish the salary review
 
13 process established by Act 358, Session Laws of Hawaii 1993.
 
14      SECTION 2.  Section 10-9.5, Hawaii Revised Statutes, is
 
15 amended to read as follows:
 
16      "[[]10-9.5[]]  Salary commission; established.(a)  There
 
17 is established a salary commission for the members of the board
 
18 of trustees for the office of Hawaiian affairs.  The salary
 
19 commission shall consist of seven members appointed by the

 1 governor on or before November 30, [1996,] 1998, and every four
 
 2 years thereafter.  The members of the salary commission shall be
 
 3 selected from nominations submitted by native Hawaiian
 
 4 organizations as defined in section 673-2(c).  The members shall
 
 5 serve without compensation, but shall be entitled to
 
 6 reimbursement for necessary expenses while in the discharge of
 
 7 their duties and responsibilities.
 
 8      (b)  Before the fortieth legislative day of the [1997]
 
 9 regular session of 1999 and every four years thereafter, the
 
10 salary commission shall study and make recommendations for the
 
11 salary of the members of the board of trustees for the office of
 
12 Hawaiian affairs, and then shall be dissolved.  The recommended
 
13 salary shall be effective as of the date of the recommendations
 
14 unless the legislature disapproves the recommendation by adoption
 
15 of a concurrent resolution prior to adjournment sine die of the
 
16 legislative session in which the recommendation is submitted."
 
17      SECTION 3.  Notwithstanding the November 30, 1998, deadline
 
18 for the appointment of salary review commissioners specified in
 
19 section 10-9.5(a), Hawaii Revised Statutes, as amended in
 
20 section 2 of this Act, the governor shall appoint a salary review
 
21 commission on approval of this Act to make its recommendations to
 
22 the legislature by the fiftieth day of the regular session of
 
23 1999, as specified in section 10-9.5(b), Hawaii Revised Statutes,

 1 as amended in section 2 of this Act.
 
 2      SECTION 4.  Statutory material to be repealed is bracketed.
 
 3 New statutory material is underscored.
 
 4      SECTION 5.  This Act shall take effect upon its approval.
