                   A  BILL  FOR  AN  ACT

RELATING TO HABITUAL CRIMINAL BEHAVIOR.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Chapter 707, Hawaii Revised Statutes, is amended
 
 2 by adding a new section to be appropriately designated and to
 
 3 read as follows:
 
 4      "§707-    Habitual criminal behavior against persons. (1)  A
 
 5 person commits the offense of habitual criminal behavior against
 
 6 persons if the person commits any of the following misdemeanor
 
 7 offenses:  section 707-712 relating to assault in the third
 
 8 degree; section 707-717 relating to terroristic threatening in
 
 9 the second degree; section 707-733 relating to sexual assault in
 
10 the fourth degree; section 709-906 relating to abuse of family
 
11 and household members, and the person has at least three prior
 
12 convictions for any of the offenses enumerated above, any of the
 
13 misdemeanor offenses enumerated in section 708-    relating to
 
14 habitual criminal behavior against property, any felony, or any
 
15 combination of the foregoing.
 
16      (2)  Habitual criminal behavior against persons is a class C
 
17 felony."
 
18      SECTION 2.  Chapter 708, Hawaii Revised Statutes, is amended
 
19 by adding a new section to be appropriately designated and to

 1 read as follows:
 
 2      "§708-    Habitual criminal behavior against property. (1)
 
 3 A person commits the offense of habitual criminal behavior
 
 4 against property if the person commits any of the following
 
 5 misdemeanor offenses:  section 708-822 relating to criminal
 
 6 property damage in the third degree; section 708-832 relating to
 
 7 theft in the third degree; section 708-833.5(2) relating to
 
 8 misdemeanor shoplifting, and the person has at least three prior
 
 9 convictions for any of the offenses enumerated above, any of the
 
10 misdemeanor offenses enumerated in section 707-    relating to
 
11 habitual criminal behavior against persons, any felony, or any
 
12 combination of the foregoing.
 
13      (2)  Habitual criminal behavior against property is a class
 
14 C felony."
 
15      SECTION 3.  New statutory material is underscored.
 
16      SECTION 4.  This Act shall take effect upon its approval.
