                   A  BILL  FOR  AN  ACT

RELATING TO SCHOOL BUSES.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 286-181, Hawaii Revised Statutes, is
 
 2 amended as follows:
 
 3      1.  By amending subsection (b) to read:
 
 4      "(b)  The department of transportation [may] shall grant
 
 5 exemptions for the use of vehicles other than school vehicles
 
 6 when the department finds that compliance with this section is:
 
 7      (1)  [Impossible] Impractical due to the unavailability of
 
 8           school vehicles; or
 
 9      (2)  Impractical due to economic factors.
 
10 No exemption shall be granted for the qualifications of
 
11 individuals driving a bus as defined in section 286-2 and such
 
12 individuals shall meet school vehicle driver qualifications."
 
13      2.  By amending subsection (i) to read:
 
14      "(i)  As used in subsection (b), a school vehicle is
 
15 unavailable [only] when it:
 
16      (1)  Is being used during a specific time for contracted
 
17           school-related transportation to and from school or
 
18           related destinations;

 1      (2)  Fails that day's inspection and has not been repaired;
 
 2      (3)  Is already in transportation service; [or]
 
 3      (4)  Is committed for transportation service[.]; or
 
 4      (5)  Does not meet the requests of a school for a motorcoach
 
 5           with undercarriage storage compartments and public
 
 6           address system; provided that the use of the motorcoach
 
 7           shall be used solely for the transportation of middle,
 
 8           intermediate, or high school student groups to and from
 
 9           school-related events or activities.  As used in this
 
10           paragraph, "motorcoach" means a vehicle that carries
 
11           more than 25 passengers, has a gross vehicle weight
 
12           rating of at least 26,000 pounds, and is no more than
 
13           15 years old."
 
14      SECTION 2.  Statutory material to be repealed is bracketed.
 
15 New statutory material is underscored.
 
16      SECTION 3.  This Act shall take effect upon its approval.
