                   A  BILL  FOR  AN  ACT

RELATING TO THE CLEAN HAWAII FUND.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Chapter 201, Hawaii Revised Statutes, is amended
 
 2 by adding to part VIII two new sections to be appropriately
 
 3 designated and to read as follows:
 
 4      "�201-     Definitions.  As used in this part:
 
 5      "Department" means the department of business, economic
 
 6 development, and tourism.
 
 7      "Director" means the director of business, economic
 
 8 development, and tourism."
 
 9      �201-     Clean Hawaii fund established.  (a)  There is
 
10 established within the state treasury a special fund to be known
 
11 as the clean Hawaii fund, which shall be administered and used by
 
12 the department to market and promote the development of local
 
13 processing and manufacturing industries for collected recycled
 
14 materials.  All moneys derived from the following sources to
 
15 market and promote the development of local processing and
 
16 manufacturing industries for collected recycled materials shall
 
17 be deposited into the fund:
 
18      (1)  Moneys appropriated to the fund by the legislature;
 
19      (2)  Moneys received by the department from federal, state,

 1           or county agencies;
 
 2      (3)  Direct transfers of funds from federal, state, or
 
 3           county agencies;
 
 4      (4)  Moneys received in fees, royalties, or premiums;
 
 5      (5)  Private grants, contracts, or gifts;
 
 6      (6)  Funds from other sources; and
 
 7      (7)  Earnings on investments.
 
 8      (b)  The department may use moneys in the clean Hawaii fund
 
 9 to:
 
10      (1)  Make grants for marketing and promoting the development
 
11           of local processing and manufacturing industries for
 
12           collected recycled materials, subject to the standards
 
13           provided in section 42F-103;
 
14      (2)  Pay for expenses, fees, or costs related to the
 
15           marketing, promotion, or development of local
 
16           processing, manufacturing, or purchasing of recycled
 
17           products; or
 
18      (3)  Pay for expenses, fees, or costs to organize, conduct,
 
19           sponsor, or cooperate with others in sponsoring
 
20           conferences, workshops, demonstrations, studies, or
 
21           other events or functions that are related to the
 
22           stimulation and formation of recycling or environmental
 
23           businesses.

 1      (c)  The director may execute contracts and adopt rules
 
 2 pursuant to chapter 91 to implement the purposes of the clean
 
 3 Hawaii fund."
 
 4      SECTION 2.  Section 9 of Act 202, Session Laws of Hawaii
 
 5 1994, as amended by Act 2, Special Session Laws of Hawaii 1995,
 
 6 is amended to read as follows:
 
 7      "SECTION 9.  The clean Hawaii center shall cease to exist on
 
 8 June 30, 1999; provided that on June 29, 1999, all unexpended or
 
 9 unencumbered balances remaining in the clean Hawaii fund
 
10 established in section 4 of Act 2, Special Session Laws of Hawaii
 
11 1995, shall be transferred to the [Hawaii capital loan program.]
 
12 clean Hawaii fund established by Act    , Session Laws of Hawaii
 
13 1999.  Section [210-   ,] 210-3.5, Hawaii Revised Statutes, shall
 
14 be repealed on June 30, 1999."
 
15      SECTION 3.  In printing this Act, the revisor of statutes
 
16 shall insert the appropriate number of this Act in section 2.
 
17      SECTION 4.  Statutory material to be repealed is bracketed.
 
18 New statutory material is underscored.
 
19      SECTION 5.  This Act shall take effect on June 28, 1999.
