RELATING TO OBLIGATIONS OF THE DEPARTMENT OF HAWAIIAN HOME LANDS TRUST FUND.
Temporarily enables DHHL to begin construction on housing and other projects without having the full and final amount of the capital costs on hand at the beginning of the project. Sunsets June 30, 2012. Establishes procedures for DHHL to determine the disposition of lands and extensions of leases for commercial and multipurpose projects. Requires DHHL to submit annual reports and deposit commercial lease revenues into the Hawaiian Home Lands Trust Fund. Includes in the offense of murder in the second degree acts committed with the intent to cause serious bodily injury to another person, which result in the death of that person. Itemized Deductions - Limits; Capital Goods Excise Tax Credit
RELATING TO TAXATION.
Temporarily places a cap on itemized deductions claimed on state income tax returns until January 1, 2016. Removes the refunding feature of the capital goods excise tax credit for eligible depreciable tangible personal property placed in service after December 31, 2009, but before January 1, 2015. RELATING TO OWNER-BUILDERS.
Amends the owner-builder law by: (1) Allowing an exemption for the sale or lease of a property by an owner builder prior to the expiration of the one-year prohibition period in the event of hardship; (2) Defining when a construction or improvement is completed; (3) Exempting improvements pursuant to an approved building permit where the estimated valuation as reflected in the building permit is less than $10,000; (4) Establishing fines for the failure of an owner-builder to comply with the requirements set forth in the disclosure statement provided to the owner-builder by the county. RELATING TO TAXATION.
Requires the Department of Taxation to provide refunds to taxpayers within 90 days of the later of (1) the due date of the tax return; or (2) the date the tax return is filed. Requires that all general revenues collected from an increase of any general excise or use tax rate be used first to pay tax refunds delayed from fiscal year 2009-2010 to fiscal year 2010-2011. Motor Vehicle Towing; Hours of Operation; Insurance
RELATING TO TOWING.
Requires towing companies to be in operation twenty-four hours per day, 7 days a week in a county with a population greater than 500,000 persons. Requires tow companies open for twenty-four hours to offer services that include the release of vehicles in storage. Requires tow operators to maintain, at minimum, $500,000 bodily injury coverage, $200,000 property damage insurance, $175,000 on-hook coverage insurance, or a combined single limit of liability insurance coverage of $1,000,000. Specifies means of payment of towing fees for consensual tows. Effective upon approval. (HB1978 CD1)

Repeals the deduction from taxable income for amounts given as political contributions effective January 1, 2011; increases the tax on cigarettes and little cigars by one cent for sales on or after July 1, 2010; and temporarily increases certain insurance fees and specifies that the increased fees be deposited equally into the compliance resolution fund and the general fund as an insurance license and service tax. Requires the department of education to make available vacant school facilities or portions of school facilities for use by charter schools, provided that the department may elect to use the facilities for education programs, with preference given to instructional purposes. Requires the charter school review panel (CSRP) to compile a prioritized list of charter schools that wish to use vacant school facilities or portions of school facilities. Makes changes to charter school funding. Requires the CSRP to determine a clear process with rigorous criteria for the reauthorization of charter schools. Requires the CSRP to reauthorize charter schools no later than four years following the initial issue of the charter, and every four years thereafter. Requires the charter school administrative office (CSAO) to withhold funds for its operational expenses, subject to certain requirements. Requires the CSAO to withhold the December 1 allocation of funds from any charter school that is not in compliance with the office financial reporting requirements. Requires the CSAO to report annually to the CSRP individual and aggregate operational and instructional expenditures of charter schools. Requires per-pupil allocation checks paid by the CSAO to individual charter schools to be co-signed by the executive director of the CSAO and an agent of the CSRP. Repeals the cap on the number of charter schools. Effective 7/1/2050.

Taxes the transfer of a taxable estate located in Hawaii by a nonresident who is not a citizen of the United States. Specifies that a decedent shall be entitled to all applicable exclusion or exemption amounts as determined under the Internal Revenue Code as of December 31, 2009, before being subject to any taxes, including up to a $3,500,000 applicable exclusion amount. RELATING TO VITAL STATISTICS.
Sets the maximum fee for a verification of a certificate issued, in lieu of a certified copy, of a vital statistic record at one half of the fee established for the first certified copy of that certificate.
