Motor Vehicle Driver Licensing
RELATING TO MOTOR VEHICLE DRIVER LICENSING.
Requires applicants for driver's licenses and instruction permits to submit proof that the applicant is legally in the United States (U.S.). Requires driver's licenses or instruction permits of legal nonimmigrants to expire no later than the date of the legal immigrant's authorized period of stay in the U.S. Requires the Director of Transportation to adopt rules and establish a verification fee. Requires the department of education, beginning with the 2010-2011 school year, to use successful assessment tools and protocols for determining a student's initial placement and for decision making about a student's movement between junior kindergarten, kindergarten, and into grade one; clarifies provisions of the early learning system, including authorizing designees for all members of the early learning council, and changing the name of the keiki first steps trust fund to the early learning trust fund. Tax Credits; Tax Exemptions; Evaluation; Report
RELATING TO TAXATION.
Amends the capital goods excise tax credit so that it applies only to property placed in service or purchased pursuant to a binding contract in taxable years beginning before July 1, 2009; suspends the credit for taxable years beginning on or after July 1, 2009, and ending on or before December 31, 2011; and adds a new part for property placed in service or purchased pursuant to a binding contract in taxable years beginning after December 31, 2011. Requires the department of taxation, with the assistance of the department of business, economic development, and tourism, to evaluate certain tax credits and tax exemptions and report to the legislature. Requires the department of taxation to give recommendations and for the legislature to implement those recommendations prior to the mandate for those tax credits and tax exemptions to sunset. Amends the application of professional employment organizations for the purposes of chapter 237, Hawaii Revised Statutes (general excise tax). Effective 7/1/50. (SD2)

Sunsets June 30, 2012. Establishes procedures for DHHL to determine the disposition of lands and extensions of leases for commercial and multipurpose projects. Requires DHHL to submit annual reports and deposit commercial lease revenues into the Hawaiian Home Lands Trust Fund. Specifies fifteen per cent of revenues generated from lease extensions to be deposited into the Native Hawaiian Rehabilitation Fund. (HB1015 CD1)

Requires the department of education to make available vacant school facilities or portions of school facilities for use by charter schools, provided that the department may elect to use the facilities for education programs, with preference given to instructional purposes. Requires the charter school review panel (CSRP) to compile a prioritized list of charter schools that wish to use vacant school facilities or portions of school facilities. Makes changes to charter school funding. Requires the CSRP to determine a clear process with rigorous criteria for the reauthorization of charter schools. Requires the CSRP to reauthorize charter schools no later than four years following the initial issue of the charter, and every four years thereafter. Requires the charter school administrative office (CSAO) to withhold funds for its operational expenses, subject to certain requirements. Requires the CSAO to withhold the December 1 allocation of funds from any charter school that is not in compliance with the office financial reporting requirements. Requires the CSAO to report annually to the CSRP individual and aggregate operational and instructional expenditures of charter schools. Requires per-pupil allocation checks paid by the CSAO to individual charter schools to be co-signed by the executive director of the CSAO and an agent of the CSRP. Repeals the cap on the number of charter schools. Effective 7/1/2050.

Taxes the transfer of a taxable estate located in Hawaii by a nonresident who is not a citizen of the United States. Specifies that a decedent shall be entitled to all applicable exclusion or exemption amounts as determined under the Internal Revenue Code as of December 31, 2009, before being subject to any taxes, including up to a $3,500,000 applicable exclusion amount. Establishes a 2-year moratorium on evictions of residents from Kahana valley state park; authorizes DLNR to negotiate and execute long-term residential leases with qualified persons in state parks; establishes the planning council to create and implement a living park master plan for Kahana valley state park; and allows DHHL to enter into commercial leases for terms in excess of 65 years but not exceeding 99 years, giving the commercial lessee a right of first refusal following a public auction at the termination of the lease; provided that the commercial lessee shall match the highest lease rental bid offered.
