Child Custody; Grandparent Visitation
RELATING TO CHILD VISITATION.
Permits family court to award reasonable visitation to grandparents if the denial of visitation would cause significant harm to the child. Establishes a rebuttable presumption that visitation decisions made by a parent are in the best interests of the child. Presumption may be rebutted by clear and convincing evidence. RELATING TO CHARTER SCHOOLS.
Raises the percentage of the annual charter school fund allocation that the charter school administrative office may withhold for operational expenses from two per cent to five per cent; provided that the charter school administrative office report annually to the legislature on the use of these funds. Promoting Prostitution; Witness Security and Protection
RELATING TO PROMOTING PROSTITUTION.
Makes various amendments regarding prostitution offenses. Amends section 28-101, Hawaii Revised Statutes, to give the "greatest priority" to cases involving promoting prostitution, when the attorney general is determining whether to fund or provide for witness security and protection. Increases the grade of offense for promoting prostitution in the first and second degree to a class A and B felony, respectively. Amends the elements of promoting prostitution in the second degree to include acts in violation of the offense of promoting prostitution in the third degree. Repeals the offense of promoting prostitution in the third degree. Expands the offenses of prostitution and solicitation of prostitution to cover patrons of prostitution. Makes the offense of habitual solicitation of prostitution a class C felony, and applies the law to those who habitually patronize prostitutes. Establishes the Agriculture Inspection and Certification Special Fund under the Department of Agriculture for the inspection, certification, weighing, or grading of agricultural commodities that are to be imported into, exported from, or shipped within the state. Deposits all fees, civil penalties, and other moneys collected by DOA into the Special Fund. Allows DOA to enter into agreements with government and private agencies to hire and pay inspectors to perform certification and audit services, maintain food safety, and establish and maintain an Internet food safety promotional and reporting system. Repeals the Certification Services Revolving Fund. Requires the establishment or increase of certain fees to cover the operation and maintenance costs of agriculture inspection and certification programs, and central services and departmental administrative expense assessments. Amends the driver's license revocation provision to require a maximum license revocation period of up to ten years upon conviction of a driver for manslaughter involving the operation of a vehicle. Gives discretion to the courts to revoke the license of any driver for up to five years upon a conviction of a driver of negligent homicide in the first degree or negligent homicide in the second degree. Allows up to two years of imprisonment when a convicted defendant is sentenced to probation for manslaughter. Clarifies that probation is an applicable sentence for manslaughter.
