RELATING TO AGRICULTURE.
Makes the offense of false labeling as to the geographic origin of Hawaii-grown coffee a class C felony. Authorizes the department of agriculture to adopt administrative rules relating to the inspection and documentation of the geographic origin of Hawaii-grown green coffee beans. Removes the requirement that all Hawaii-grown green coffee beans shall be inspected and certified by the Department of Agriculture unless otherwise specified by rules of the Department. Requires that no Hawaii-grown coffee beans shall be shipped outside the area of their geographic origin unless they have been marked with or contain documentation of geographic origin approved by the department of agriculture. Enacts the Uniform Military and Overseas Voters Act to ensure ability of members of the military and others eligible voters who are overseas to participate in all elections for federal, state, and local offices. Uniform Collaborative Law Act
RELATING TO THE HAWAII UNIFORM COLLABORATIVE LAW ACT.
Enacts Uniform Collaborative Law Act, which authorizes disputants to enter into collaborative law participation agreements signifying interest to resolve the dispute without intervention of a tribunal (court or other third party decision maker). Requires parties to a collaborative law process to disclose information fully, candidly, and informally without formal discovery. Subject to certain exceptions, disqualifies attorneys in the collaborative process (and their law firms) from appearing before a tribunal to represent a party in a proceeding related to the collaborative matter. Requires those sentenced for agricultural theft to provide restitution to the victim. Requires proof of identification from sellers of agricultural commodities. Establishes criminal penalties for failure to maintain a certificate of ownership or other written proof of ownership of agricultural commodities. Makes theft of agricultural commodities an offense of theft in the second degree and establishes lack of ownership or movement certificates as prima facie evidence of the theft. (SD2)

Stipulates that the five per cent decrease to the legislative, executive, and judicial salaries applies to what the respective salaries were as of June 30, 2009, and remains at the specified salary rate until June 30, 2013. Repeals Act 85, Session Laws of Hawaii (SLH) 2009, as amended by Act 57, SLH 2011, as amended by this Act, at 11:59 p.m. on June 30, 2013. Amends drivers license revocation provisions to require revocation for a period of time as determined by the sentencing court when a driver is convicted of manslaughter involving a vehicle or for negligent homicide in the first or second degrees. Allows for a term of imprisonment when a convicted defendant is sentenced to probation for manslaughter for a period of time to be determined by the sentencing court. Provides for non-liability of religious organizations and religious facilities under certain circumstances. Ensures that rights held by certain reciprocal beneficiaries carryover to a civil union; provided that the reciprocal beneficiaries terminated their relationship simultaneously with or within ninety days after the termination of the reciprocal beneficiary relationship. Extends rights created by the solemnization of a civil union that were not included within a reciprocal beneficiary relationship to be recognized as of the date the civil union was solemnized. Amends various statutory provisions relating to solemnizations. Authorizes name change on the certificate of civil union. Confirms the family court has jurisdiction over the divorce, annulment, and separation of a union that is recognized as a civil union in this State. Allows reciprocal beneficiaries who enter into a legal union in another jurisdiction that is not marriage have their legal union recognized as a civil union; effective upon approval. Exempts religious organizations from liability under certain circumstances when refusing to make a religious facility available for solemnization of a civil union. Extends the statute of limitations for civil actions brought by persons subjected to sexual offenses as a minor against the person who committed the act. Revives for a two-year period certain actions for which the statute of limitations had previously lapsed. Excludes the State and its political subdivisions as legal entities against whom a claim for gross negligence may be brought during the two-year window period.
