MAKING AN EMERGENCY APPROPRIATION TO THE OFFICE OF THE GOVERNOR RELATING TO COVID-19 EXPENDITURES.

Provides an emergency appropriation in an unspecified amount to the office of the governor in fiscal year 2020-2021 to continue funding for various COVID-19 response related programs and activities.  Requires, before the expenditure of any funds by the office of the governor, for the establishment of a task force to develop recommendations on the roles and responsibilities of the department of the attorney general and the county police departments regarding COVID-19 emergency order enforcement.  Requires the governor, before the expenditure of any funds, to establish a statewide tier system, to be deployed at the county level, that include clear metrics for allowable business activities, other allowable activities, and in-person gathering restrictions  Appropriates funds to the department of the attorney general for enforcement of COVID-19 emergency orders and rules.  Effective 7/1/2050.  (SD2)

RELATING TO EMERGENCY POWERS.

Prohibits the governor or the mayor from suspending requests for public records or vital statistics during a declared state of emergency.  Effective 7/1/2050.  (SD1)

RELATING TO EMERGENCY RULES.

Allows for lesser emergency period penalties to be adopted and promulgated by the governor or a mayor.  Allows for the emergency period infractions to be processed under the traffic adjudication process in chapter 291D, Hawaii Revised Statutes.  Allows electronic copies of notices of infractions, infraction adjudication hearings, and notices of infraction judgments to be sent via email.  Grants the District Court concurrent jurisdiction over emergency period rule infractions committed by minors.  (SD1)

RELATING TO THE COMPTROLLER.

Expands Comptroller's duties to include the assessment of office space, including initiating, canceling, and renegotiating current and new leases, office space allocation, and telework infrastructure requirements for agencies and employees occupying facilities managed by the Department of Accounting and General Services.  Effective 7/1/2050.  (SD2)

Status

RELATING TO SUNSHINE LAW BOARDS.

Expands board and public participation by giving boards the option, in conjunction with in-person meetings, to use interactive conference technology to remotely conduct public meetings under the Sunshine Law, even when no emergency has been declared by government authorities.  Authorizes boards to exclude the public from nonpublic locations, such as homes, where board members are physically present when remote board meetings are held by interactive conference technology, with members of the public given the option to participate either remotely or at an in-person public location.  Establishes requirements for the conduct of remote meeting.  Requires remote meetings held by interactive conference technology to recess for a maximum prescribed period when audiovisual communication cannot be maintained by the board (not due to a member of the public's inability to maintain such communication) and allows the meeting to be reconvened even if only audio communication can be reestablished.  Establishes a new notice requirement to provide the board's contact information for the submission of written testimony by electronic or postal mail, which also applies to remote meeting agendas.  Amends existing option to hold in-person meetings at multiple public meeting sites connected by interactive conference technology to require termination of meeting only if audio communication is lost and cannot be reestablished within twenty minutes and the board had not provided reasonable notice of how the meeting would be continued.  Allows for additional courtesy sites open to the public for both remote and in-person meetings held by interactive conference technology.  Effective 5/6/2137.  (SD1)

DECISION MAKING TO FOLLOW

 

Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing.  Testimony received after this time will be stamped late and left to the discretion of the chair to consider.  While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may not be processed.

 

Testimony submitted will be placed on the legislative website.  This public posting of testimony on the website should be considered when including personal information in your testimony.

 

The chair may institute a per-testifier time limit.

 

Committees meeting in the morning must adjourn prior to the day's Floor Session.  Therefore, due to time constraints, not all testifiers may be provided an opportunity to offer verbal comments.  However, remote testitfiers' written submissions will be considered by the committee.

 

Please refrain from profanity or uncivil behavior.  Violations may result in ejection from the hearing without the ability to rejoin.

 

The House will not be responsible for bad connections on the testifier's end.
