RELATING TO CHILD SAFETY.

Authorizes disclosure of the disposition of an assessment from an investigation into an allegation or report of child abuse and neglect that was confirmed by DHS and occurred within a group child care home or a group child care center to parents or guardians of a child enrolled in the home or center at the time of the alleged abuse or neglect or to parents or guardians who have submitted an application or request to place their children in that home or center.  Establishes a working group to review laws, rules, and procedures relating to the coordination of investigations and enforcement efforts of the child welfare services branch and child care licensing program.  Requires the working group to report to the legislature prior to the regular sessions of 2019 and 2020.  Effective 7/1/3000.  (SD1)

Amends the cesspool upgrade, conversion, or connection income tax credit pilot program by repealing the provision that restricts DOH from certifying more than two residential large capacity cesspools as qualified cesspools.  Effective 1/28/2045.  (SD1)

Requires the Attorney General to defend any civil action or proceeding against a county and any person employed by the county to provide lifeguard services at a designated state beach park under an agreement between the State and the county.  Appropriates funds to the Department of Land and Natural Resources to contract with the counties for county lifeguard services at designated state beach parks under an agreement between the State and a county.  Effective 7/1/2035.  (SD2)

RELATING TO CITATIONS FOR MOTOR VEHICLE REPAIR VIOLATIONS.

Authorizes the issuance of a citation for specific violations of the motor vehicle repair laws and rules by licensees.  Sets forth a process for licensees to contest the citation and provides for the assessment of fines for each violation.  (SD2)

RELATING TO HUMAN SERVICES.

Requires criminal history checks of adult relatives who provide care for a child whose family receives a child care subsidy from the Department of Human Services.  Clarifies that the Department of Human Services may take administrative and judicial action to enforce child care licensing provisions of Chapter 346, Hawaii Revised Statutes.  Clarifies the role and response of the Child Care Licensing Program when it receives a report of death or injury of a child in a child care setting, and addresses the release of information pending an investigation.  Takes effect 7/1/2525.  (SD1)

RELATING TO PHYSICIAN ASSISTANTS.

Establishes biennial requirements of forty credit hours in specified continuing medical education programs for renewal of physician assistant license, beginning with the renewal for the licensing biennium on 2/1/2020, and every biennial renewal thereafter.  Authorizes the Hawaii Medical Board to conduct random document audits to enforce compliance.  (SD1)

RELATING TO TRANSIENT ACCOMMODATIONS.

Allows a transient accommodations broker to register as a tax collection agent for its operators and plan managers.  Requires operators and plan managers to provide a statement to the transient accommodations broker confirming compliance with all applicable land use and tax laws.  Requires the operator or plan manager to provide verification of compliance with state and county land use laws.  Requires an operator or plan manager to remove a transient accommodation advertisement upon notice that the property is not in compliance with state law or county ordinance.  Establishes a 1-time amnesty program for certain delinquent transient accommodations and general excise tax obligations.  Authorizes counties to require the disgorgement of profits obtained through unlawful actions.  Authorizes counties to adopt ordinances to amortize or phase out transient vacation rental units.  Allocates up to $1,000,000 of TAT revenues to each county, contingent upon the county establishing a process to provide verification of compliance by an operator or plan manager with county land use laws.  Makes it unlawful for transient accommodations brokers to engage in business with operators or plan managers or property managers or activity providers that are not in compliance with all state laws and county ordinances.  Makes it unlawful for a hosting platform to provide, and collect a fee for, booking services regarding transient vacation rentals that are not lawfully certified, registered, or permitted under applicable county ordinance.  (SD2)

RELATING TO WIRELESS BROADBAND FACILITIES.

Establishes a process to upgrade and support next generation wireless broadband infrastructure throughout the State.  Establishes a permitting, application, review, and approval process for wireless service providers to install wireless facilities on state or county owned utility poles, or install associated utility poles, in the right of way.  Effective 7/1/2050.  Applies to permit applications filed with the State or county after 12/31/2018.  (SD1)

RELATING TO LICENSING.

Clarifies that the licensing requirements for hearing aid dealers and fitters shall not apply to audiologists licensed pursuant to chapter 468E, Hawaii Revised Statutes.  Clarifies that to be eligible for licensure as an audiologist, a person shall not be required to also be licensed as a hearing aid dealer and fitter.  (SB2258 HD2)

Establishes the Kawailoa Youth and Family Wellness Center within the Department of Human Services under the supervision of the Office of Youth Services and the Hawaii Youth Correctional Facilities.  Appropriates funds to the Department of Human Services for the operational costs of an organization providing prevention, intervention, and group and individual counseling for high risk youth.  (SB2791 HD1)

RELATING TO ENVIRONMENTAL PROTECTION.

Requires commercial agricultural entities to report on their use of restricted use pesticides to the Department of Agriculture (DOA).  Prohibits the use of a restricted use pesticide within 100 feet of a school during instructional hours beginning one year after effective date.  Prohibits the use of pesticides containing chlorpyrifos as an active ingredient beginning 1/1/2019; provided that the DOA shall grant any person, upon request, a temporary permit allowing the use of pesticides containing chlorpyrifos through 12/31/2021.  Provides for the deposit into the pesticide use revolving fund of all penalties and fines collected under the Hawaii Pesticides Law.  Revises the ceiling and use of the pesticide use revolving fund.  Appropriates money into and out of the pesticide use revolving fund.  Authorizes the establishment of two full-time equivalent positions.  (SB3095 HD1)

RELATING TO THE STRUCTURE OF GOVERNMENT.

Consolidates the Department of Budget and Finance and the Department of Human Resources Development into the Department of Budget, Finance, and Human Resources.  Transfers functions and duties accordingly.  Transfers to the Department of Business, Economic Development, and Tourism (DBEDT) jurisdiction over cable TV and the Broadband Assistance Advisory Council from the Department of Commerce and Consumer Affairs and telecommunications carriers from the Public Utilities Commission.  Establishes the position of a commissioner of telecommunications.  Creates special fund in DBEDT for cable TV and telecommunications carriers.  Requires the Broadband Assistance Advisory Council to advise the Director of DBEDT on broadband deployment.  (SB3100 HD1)
