Resolves inconsistencies in the processing of expungements and public dissemination of criminal history record information relating to cases in which the defendant is acquitted or charges are dismissed by reason of physical or mental disease, disorder, or defect under chapter 704, Hawaii Revised Statutes, or is involuntarily hospitalized under section 706-607, Hawaii Revised Statutes.  Effective 7/1/2035.  (SD1)

RELATING TO CONFIDENTIAL PERSONAL INFORMATION.

Amends the definition of "confidential personal information," in section 708-800, Hawaii Revised Statutes (HRS), to eliminate unconstitutionally vague provisions in the law as determined by the Hawaii Supreme Court, in its decision of State v. Pacquing, 139 Haw. 302, 389 P.3d 897 (2016).  (SD1)

Provides that whenever an election officer is required to issue a public notice in a statewide or county publication, the publication requirement is satisfied upon the submission of the notice to the publication, provided that the notice is also posted on the website associated with the election officer.

Exempts signs and banners from the requirement that campaign advertisements contain the name and address of the candidate, candidate committee, noncandidate committee, or other person paying for the advertisement and notice of whether that the sign or banner has the approval of the candidate; provided that signs and banners advocating passage or defeat of an issue or question on the ballot are required to contain the name and address of the candidate, candidate committee, or noncandidate committee paying for the sign or banner.  (SD1)

Amends false claims to the State statute by increasing penalties to maintain consistency with the federal False Claims Act and in order to comply with the Federal Civil Penalties Inflation Adjustment Act of 1990.  (SD2)

RELATING TO STATUTORY REVISION:  AMENDING OR REPEALING VARIOUS PROVISIONS OF THE HAWAII REVISED STATUTES AND THE SESSION LAWS OF HAWAII FOR THE PURPOSES OF CORRECTING ERRORS AND REFERENCES, CLARIFYING LANGUAGE, AND DELETING OBSOLETE OR UNNECESSARY PROVISIONS.

Amends or repeals various provisions of the Hawaii Revised Statutes and the Session Laws of Hawaii for the purposes of correcting errors and references, clarifying language, and deleting obsolete or unnecessary provisions.  Effective 7/1/2035.  (SD1)

Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing.  Testimony should indicate:

·     Testifier's name with position/title and organization;

·     The Committee(s) to which the comments are directed;

·     The date and time of the hearing; and

·     Measure number. 

 

While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may be distributed to the Committee after the hearing.

 

Submit testimony in ONE of the following ways:

PAPER:  3 copies (including an original) to Room 302 in the State Capitol;

FAX:       For testimony less than 5 pages in length, transmit to 808-586-6531 (Oahu) or 1-800-535-3859 (for Neighbor Islander without a computer to submit testimony through e-mail or the Web); or

WEB:     For testimony less than 20MB in size, transmit from http://www.capitol.hawaii.gov/submittestimony.aspx.

 

Testimony submitted will be placed on the legislative website.  This public posting of testimony on the website should be considered when including personal information in your testimony.
