Appropriates funds for fiscal biennium 2017-2019 for collective bargaining cost items, salary increases, and other cost adjustments for public employees in collective bargaining unit (14) and for their excluded counterparts.

Requires mayors to report collective bargaining unit negotiations to their respective county councils.

Requires public employees in collective bargaining units to provide written notification to the exclusive representative to discontinue payroll assignments within a certain time period.  Requires the exclusive representative to forward the notification to the employer within ten business days of receipt.

RELATING TO COLLECTIVE BARGAINING.

Provides that negotiations over the implementation of management decisions affecting the terms and conditions of employment that are subject to collective bargaining are not precluded from collective bargaining negotiations.  Specifies that negotiations over the procedures and criteria of certain subjects of bargaining does not compel either party to agree to a proposal or make a concession.

Appropriates funds for permanent civil service positions and equipment for the Hawaii Public Housing Authority to provide services historically and customarily performed by civil service employees in connection with refuse collection.

RELATING TO EMPLOYEE TRAINING.

Establishes the Public Employees Training Program within the Department of Human Resources Development to provide training programs to improve and enhance state employees' understanding of their job duties.  Allocates one percent of collective bargaining increases to the Public Employees Training Program.

RELATING TO QUALIFIED DOMESTIC RELATIONS ORDERS.

Allows the Employees' Retirement System to make direct payments to spouses or former spouses of ERS members or retirants to include former spouses or former members with vested benefit status when the former spouse has been awarded all or a portion of ERS retirement benefits as ordered or decreed in a domestic relations proceeding.  Makes the ERS benefits payable to an alternate payee.  Delays implementation of Act 263, Session Laws of Hawaii 2016, to July 1, 2020.

RELATING TO LABOR.

Requires employers to provide a minimum amount of paid sick leave to employees to be used to care for themselves or a family member who is ill or needs medical care, or due to a public health emergency.  Gives employers flexibility to offer paid sick leave to minimum wage and other employees or to pay minimum wage employees a salary that is more than the minimum wage.

RELATING TO FAMILY LEAVE.

Requires the Department of Labor and Industrial Relations to establish paid family leave for all workers by January 1, 2020.  Authorizes DLIR to adopt interim rules.  Establishes the Paid Family Leave Implementation Board to assist DLIR and report to the Legislature.  Requires the Legislative Reference Bureau to conduct a study, including an actuarial analysis, on aspects of implementing paid family leave.  Establishes a Paid Family Leave Special Fund.  Appropriates funds.

RELATING TO WORKERS' COMPENSATION.

Establishes training options as part of vocational rehabilitation for injured employees when training for employment in another occupational field is required for the employee and as part of the employee's rehabilitation plan.  Provides that all professional and clerical employees of the Department of Labor and Industrial Relations Rehabilitation Unit are to be administered by the DLIR Director.

RELATING TO TEMPORARY DISABILITY INSURANCE.

Permits advanced practice registered nurses to certify an employee's disability. Increases the penalty an employer is assessed for failing to submit timely wage and employment information. Permits filing of an appeal of a decision related to temporary disability insurance at the various offices of the Department of Labor and Industrial Relations throughout the State. Allows the department to send notices of hearing electronically or by first-class mail. Clarifies that when the notice of hearing cannot be delivered to a party in the appeal, the notice may be given by online posting on the department's webpage. Allows the parties to a hearing to appear in person, via telephone, or by other communication devices.

RELATING TO STANDARDIZED TESTING.

Limits the number of standardized tests students take in a school year.  Requires the Board of Education to conduct a statewide survey of school administrators and teachers to determine the time spent on preparing for standardized tests and the impact of preparation time on the quality of instruction.

Establishes a Law Enforcement Standards Board for the certification of county police officers, state public safety officers, and employees of the Departments of Transportation, Land and Natural Resources, Taxation, and Attorney General with police powers.  Establishes the Law Enforcement Standards Board Special Fund.  Appropriates funds.

RELATING TO LAW ENFORCEMENT.

Establishes an enforcement division in the Department of the Attorney General.  Transfers to the Department of the Attorney General Enforcement Division the law enforcement activities of the Department of Land and Natural Resources Division of Conservation and Resources Enforcement; Department of Public Safety state law enforcement officers and narcotics enforcement investigators with the Narcotics Enforcement Division; and Department of Transportation Harbors Division.  Repeals the sunset of Act 116, Session Laws of Hawaii 2013, as amended by section 4 of Act 101, SLH 2015.

RELATING TO INFORMATION TECHNOLOGY.

Provides the Chief Information Officer with full discretion to require independent verification and validation of the information technology projects if certain criteria are met.  Requires certain information technology projects to adhere to statewide information technology governance and provides a review process developed by the Chief Information Officer for the information technology project.

RELATING TO GOVERNMENT OPERATIONS.

Transfers to the Department of Business, Economic Development, and Tourism (DBEDT) jurisdiction over cable TV and the Broadband Assistance Advisory Council from the Department of Commerce and Consumer Affairs and telecommunications carriers from the Public Utilities Commission.  Establishes the position of a commissioner of telecommunications.  Creates special fund in DBEDT for cable TV and telecommunications carriers.  Requires the Broadband Assistance Advisory Council to advise the Director of DBEDT on broadband deployment.

RELATING TO ETHICS.

Prohibits any Governor or county Mayor, while serving in their respective individual capacities as Governor or county Mayor, to maintain any other employment or receive any emolument, beginning on the sixty-first calendar day after their election or appointment to office.
