A BILL FOR AN ACT

 

 

RELATING TO HEALTH.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     The legislature finds that Hawaii's visitor drowning rate is 13 times the national average and nearly 10 times the rate of Hawaii residents from 2003 to 2012, with snorkeling by far the most common activity in which a fatal accident occurs. The legislature also finds that in 2003 to 2012, state data shows 102 visitors drowned while snorkeling compared to 13 residents. Further, from 2009 to 2013 79 people died because of snorkeling in Hawaii. 

     The purpose of this measure is to develop consistent and strong messages and information to inform visitors and residents of the dangers of snorkeling. The legislature finds that it is essential to provide as much information on concerns with snorkeling to Hawaii's visitors and residents to address the significant fatalities associated with snorkeling in Hawaiian waters.

     SECTION 1.  Chapter 200, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§200-    Snorkel; safety checklist.  (a)  No person or store shall rent or sell a snorkel without attaching a warning check list on the snorkel.

     (b)  The department shall adopt rules pursuant to chapter 91 to effectuate this section."

     SECTION 2.  Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.

Description:

Rental Shops and stores shall place a warning page or card listing a Safety Check List for snorkels sold or rented in Hawaii.
