A BILL FOR AN ACT

 

 

RELATING TO LAND USE.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Section 173A-7, Hawaii Revised Statutes, is amended to read as follows:

     "[[]§173A-7[]]  Administration and management.  (a)  The board [shall], subject to chapter 171, shall administer, maintain, and manage any land acquired under [the provisions of] this chapter, may charge [such] fees for the use of [any such] the land as it considers to be reasonable, and may construct on [such] the land any improvement [which] that it deems to be necessary to carry out the purposes of this chapter.  The board may adopt and from time to time amend [regulations] rules implementing [the provisions of] this chapter.

     (b)  The board shall provide an annual report to the legislature no later than twenty days prior to the convening of each regular session with the following information:

     (1)  A list of all of the lands that are held by the department and the current zoning status of those lands;

     (2)  A list of all of the lands that are under lease, along with:

          (A)  The current lease rent for the land;

          (B)  The amount of years remaining under the lease; and

          (C)  The status of the land if the lease is near the end of its term;

     (3)  A list of all the lands that are land banked or not under the lease and:

          (A)  The current market value of the land; and

          (B)  The status of the land to be leased; and

     (4)  A list of all ceded lands and:

          (A)  The current zoning of the ceded lands;

          (B)  The current status of the ceded lands;

          (C)  The value of ceded lands that are under lease; and

          (D)  The value of any ceded lands that are not under lease.

     (c)  The board shall also provide the legislature with a portfolio of lands that can be leased immediately for either agricultural use or affordable housing."

     SECTION 2.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect on July 1, 2050.

Requires the Board of Land and Natural Resources to provide an annual report to the Legislature with information regarding the value, current zoning, and status of resource value public lands held by the Department of Natural Land and Resources.  (HB1985 HD1)
