A BILL FOR AN ACT

 

 

RELATING TO BICYCLES.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Section 291C-145, Hawaii Revised Statutes, is amended by amending subsection (c) to read as follows:

     "(c)  Whenever a usable bicycle lane has been provided on a highway, any person operating a bicycle [at a speed less than the normal speed of traffic moving in the same direction at such time] shall ride within [such] the bicycle lane, except that [such] the person may move out of the lane under any of the following situations:

     (1)  When overtaking and passing another bicycle, vehicle, or pedestrian within the lane or about to enter the lane if [such] overtaking and passing cannot be done safely within the lane;

     (2)  When preparing for a left turn at an intersection or into a private road or driveway; or

     (3)  When reasonably necessary to leave the bicycle lane to avoid debris or other hazardous conditions.

     Any person in violation of this subsection shall be fined not more than $         per violation."

     SECTION 2.  Section 291C-148, Hawaii Revised Statutes, is amended by amending subsection (b) to read as follows:

     "(b)  Unless otherwise prohibited, a bicycle may be driven at a speed of ten miles per hour or less on a sidewalk or sidewalk area; provided that [the]:

     (1)  The driver of the bicycle shall yield the right-of-way to any pedestrian [and that bicycle];

     (2)  Bicycle riding shall be prohibited on sidewalks in business districts[.]; and

     (3)  Whenever a usable bicycle lane is available, the driver of the bicycle shall ride within that bicycle lane, except that the driver may move out of the bicycle lane under any of the following situations:

          (A)  When overtaking and passing another bicycle, vehicle, or pedestrian within the lane or about to enter the lane if overtaking and passing cannot be done safely within the lane;

          (B)  When preparing for a left turn at an intersection or into a private road or driveway; or

          (C)  When reasonably necessary to leave the bicycle lane to avoid debris or other hazardous conditions.

     Any person in violation of this subsection shall be fined not more than $         per violation."

     SECTION 3.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

     SECTION 4.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 5.  This Act shall take effect on July 1, 2050.
