A BILL FOR AN ACT

 

 

RELATING TO HOMELAND SECURITY.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 128A, Hawaii Revised Statutes is amended by amending section 128A-3 to read as follows

     "[§128A-3] State office of homeland security.  (a)  There shall be established within the department of defense an office of homeland security and, subject to the direction and control of the governor, shall oversee the agency.  The director of homeland security shall employ appropriate personnel and make expenditures as may be necessary to carry out this chapter.  The director shall appoint an administrator of homeland security who shall be exempt from chapter 76, subject to removal by the director, and receive compensation as the director may determine.

     (b)  The director shall be responsible for formulating and carrying out programs for homeland security.  The director shall:

     (1)  Ensure coordination and cooperation among all organizations for homeland security; public agencies, including county, state, and federal agencies; and private organizations; and

     (2)  Cooperate with county, state, and federal homeland security and law enforcement agencies."

     SECTION 2.  Chapter 128A, Hawaii Revised Statutes is amended by adding a new section to read as follows

     "[§128A-___]  Hawaii state fusion center.  (a)  The office shall establish and operate a state fusion center that shall be known as the Hawaii state fusion center.  The director of homeland security, subject to the direction and control of the governor, shall oversee the hawaii state fusion center.

     (b)  There shall be a hawaii state fusion center director who shall be appointed, and may be removed, by the director of homeland security.  The director of the hawaii state fusion center shall be responsible for the day-to-day operations of the hawaii state fusion center.  The director of the hawaii state fusion center shall not be subject to chapter 76.

     (c)  The hawaii state fusion center shall

     (1)  be continually staffed by to monitor all-crimes and hazards and shall be the focal point for sharing local, national, and international information and context with the national level intelligence community.

     (2)  collaborate among all levels of government to receive, analyze and disseminate threat-related information in coordination with multi-disciplinary partners.

     (3)  establish a joint integration center to:

         (i)  integrate information technology, cybersecurity, and cybercrime prevention, cyber and analytic capabilities, and to improve situational awareness related to critical infrastructure/key resources protection of lifelines.

        (ii)  coordinate with local, state and federal agencies for asset response activities to include furnishing technical assistance to affected entities to protect their assets, mitigate vulnerabilities, and reduce impacts of cyber incidents; identifying other entities that may be at risk and assessing their risk to the same or similar vulnerabilities; assessing potential risks to the state or region, including potential cascading effects, and developing courses of action to mitigate these risks; facilitating information sharing and operational coordination to respond to threats; and providing guidance as to how best to utilize Federal resources and capabilities in a timely, effective manner to speed recovery.

       (iii). Provide Intelligence support and related activities facilitate the building of situational threat awareness and sharing of related intelligence; the integrated analysis of threat trends and events; the identification of knowledge gaps; and the ability to degrade or mitigate adversary threat capabilities."

     SECTION 3.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval and shall be effective in all lawsuits filed as of and after its approval.

RELATING TO HOMELAND SECURITY

 

Description:

With the numbers of threats and incidents against the country which have arisen in the recent past, it is even more crucial that the State of Hawaii, as a strategic location in the Pacific, have all information necessary to guard against those who would do harm to the country and to the state.  In the current atmosphere of increased terrorist activities, it is even more important that the Hawaii State Fusion Center be fully staffed and supported.  This bill adds the fusion center as a program under the existing Office of Homeland Security and establishes the position of director of the fusion center who shall be responsible to the director of homeland security and accountable to manage the day-to-day operations of the fusion center.
