RELATING TO THE CAPITAL INFRASTRUCTURE TAX CREDIT. Proposed HD1: Includes structures, machinery, equipment, and capital assets in the definition of capital infrastructure costs. Sets a new maximum amount of capital infrastructure tax credits that may be issued in any taxable year per qualified infrastructure tenant. Specifies that excess tax credits may be carried forward.

RELATING TO AGRICULTURE. Proposed HD2: Establishes within the Livestock Revitalization Program a grant program for qualified feed developers. Appropriates funds for the Feed Developer Grant Program, reimbursements to Qualified Producers for feed cost, and a survey of local feed ingredient sources. Appropriates funds for the Future Farmers of America program.

RELATING TO INVASIVE SPECIES. Proposed HD2: Mandates the Department of Agriculture and the Hawaii Invasive Species Council to perform specified tasks to address the interisland spread of invasive species. Mandates the Department of Agriculture to establish a little fire ant Pesticide Treatment Coupon Pilot Project and site map. Requires annual reports.

MAKING AN EMERGENCY APPROPRIATION FOR THE DEPARTMENT OF THE ATTORNEY GENERAL. Makes an emergency appropriation to the Department of the Attorney General for retention of expert witnesses and specialized legal counsel in major litigation against the State of Hawaii.

RELATING TO GOVERNMENT RECORDS. Requires agencies to exercise reasonable care in the maintenance of all government records under its control that are required to be made available for public inspection.

RELATING TO ELECTIONS. Establishes a process for the recounting of ballots cast in a contest. Authorizes that contests for cause challenging a contest result may also be based upon unlawful activity or force majeure.

RELATING TO RESTITUTION FOR VICTIMS OF CRIME. Clarifies that reimbursement to crime victims includes lost wages and mental health treatment, counseling, and therapy.

RELATING TO THE HAWAII PENAL CODE. Requires the Department of Public Safety to send written notice to defendants with terms of imprisonment imposed prior to June 18, 2008, to notify these defendants that the department may recalculate their multiple terms of imprisonment and of their rights to have the court review their sentences.

RELATING TO LIQUOR COMMISSIONS. Requires county liquor commissions to prescribe regulations on dancing in establishments licensed to serve alcohol through the adoption or amendment of administrative rules.

RELATING TO STARLIGHT RESERVE. Extends the existence of the Starlight Reserve Advisory Committee until June 30, 2021. Amends the Office of Hawaiian Affairs' representative on the committee. Requires the Starlight Reserve Advisory Committee to report to the Legislature prior to the regular sessions of 2017 and 2019.

RELATING TO THE PACIFIC INTERNATIONAL SPACE CENTER FOR EXPLORATION SYSTEMS SPECIAL FUND. Establishes the Pacific international space center for exploration systems special fund for the operation, maintenance, and management of the Pacific international space center for exploration systems' projects, facilities, services, and publications. Effective 7/1/2050.

RELATING TO THE NATURAL ENERGY LABORATORY OF HAWAII AUTHORITY. Provides Enterprise Zone incentives for qualified renewable energy technology business activity on real property owned by the Natural Energy Laboratory of Hawaii Authority.

RELATING TO PUBLIC SCHOOL LANDS. Requires public school lands that are leased to benefit public educational purposes rather than simply to be used for public purposes. Authorizes the DOE to enter into leaseback agreements.

Requires, and appropriates funds for, the Department of Education to continue developing and administering annual non-translated assessments in the Hawaiian language of established statewide performance standards for students in the Hawaiian language immersion program. RELATING TO THE AHA MOKU ADVISORY COMMITTEE. Appropriates funds for the administration and operation of the Aha Moku Advisory Committee and for community outreach.

Requires inclusion of position ceilings in the executive budget and related documents and separate identification of the maximum number of permanent and temporary positions authorized. Prohibits the expenditure of funds on positions exceeding the applicable ceiling, with certain exceptions. Applies to Executive and Judicial Branch budgets and documents.

RELATING TO THE EMPLOYEES' RETIREMENT SYSTEM. Provides for vested death benefits for Hybrid members who become members of the Employees' Retirement System after June 30, 2015; extends period for mandatory refund of contributions to the Employees' Retirement System.

RELATING TO THE EMPLOYEES' RETIREMENT SYSTEM. Requires an employee receiving workers' compensation benefits to have retirement contributions deducted from those benefits. Establishes prospectively applicable, 1-year deadlines for claims for service credits and for commencement of payments. Provides for payment for acquisition based on actuarial cost.

RELATING TO DIVORCE. Provides statutory authority for the ERS Administrator to make direct payment of benefits to a former spouse of a member pursuant to valid court judgment, order, or decree for divorce. Allows for the ERS Administrator to assess a ten per cent administrative fee.

RELATING TO WAGE AND HOUR LAW. Increases the amount of guaranteed monthly compensation required to exempt an individual from minimum wage, overtime, and record keeping requirements under the Hawaii Wage and Hour Law by way of a formula.

RELATING TO FIREFIGHTERS. Establishes a rebuttable presumption that a firefighter who suffers from cancer, blood-borne infectious diseases, or conditions related to hazardous material exposure contracted it in the course of employment. Benefits include one-hundred per cent average weekly wages, disability indemnity, and death benefits.

Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing. Testimony should indicate:
· Testifier's name with position/title and organization;
· The Committee(s) to which the comments are directed;
· The date and time of the hearing; and
· Measure number.
While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may be distributed to the Committee after the hearing.
