A BILL FOR AN ACT

 

 

RELATING TO ABUSE OF FAMILY OR HOUSEHOLD MEMBERS.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Section 709-906, Hawaii Revised Statutes, is amended by amending subsection (8) to read as follows:

     "(8)  Where the physical abuse consists of intentionally or knowingly impeding the normal breathing or circulation of the blood of the family or household member by applying pressure on the throat [or the], neck, mouth, or nose, abuse of a family or household member is a class C felony."

     SECTION 2.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

     SECTION 3.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.

Description:

Adds the mouth and nose of a family or household member to the types of body parts on which pressure that is applied to intentionally or knowingly impede normal breathing or blood circulation shall constitute abuse of a family or household member as a class C felony.
