A BILL FOR AN ACT

 

 

relating to foreclosures.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Section 667-25, Hawaii Revised Statutes, is amended by amending subsection (c) to read as follows:

     "(c)  [The public sale of the mortgaged property shall be conducted by the foreclosing mortgagee] The foreclosing mortgagee shall conduct the public sale of the mortgaged property on the date, at the time, and at the place described in the public notice of the public sale."

     SECTION 2.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
