A BILL FOR AN ACT


 

 

RELATING TO EDUCATION.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Over the past several years, the Hawaii teacher standards board has worked to electronically interface with public and private Hawaii teacher education institutions and the department of education to share information about licensed teachers.  The board's goal is to receive data from these institutions and agencies in a way that expedites operations and avoids the duplicative collection of data by multiple institutions and agencies.  In accordance with the federal Higher Education Opportunity Act, data sharing between the State and higher education institutions is now federally mandated.  In addition, data sharing will enable all parties to expedite the performance of their duties and responsibilities.  The data-sharing effort provided for in this Act has three facets:

     (1)  Technology;

     (2)  Functionality; and

     (3)  Project management and coordination.

     SECTION 2.  As a result of legislation passed in 2008, the Hawaii teacher standards board has worked with teacher education institutions and the department of education to determine a mutually acceptable data transfer method for the exchange of data.  The board has also worked with participating organizations on the list of transactions that each organization will provide.  The transactions will include all information that the participating institutions or agencies store in their automated systems that support teacher licensing, relicensing, education, and hiring, including but not limited to license information for current licensees, application information for applicants, state-approved teacher education program completion information, university course completion information for licensees, higher education degree information, teacher employment and work site information, and teacher termination, resignation, retirement, and leave status.

     SECTION 3.  The purpose of this Act, as supported by the teacher education coordinating committee, is to authorize funds to the Hawaii teacher standards board to coordinate an effort to create a network between the teacher education institutions and the department of education to support the interchange of information identified and agreed to by the participating organizations.  Further, it is the purpose of this Act to provide funds to achieve this interchange.

     SECTION 4.  There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2009-2010 and the same sum or so much thereof as may be necessary for fiscal year 2010-2011 for the purposes of this Act; provided that:

     (1)  An assessment of available internal resources and additional resources required shall be used to determine the funding needed to implement this part; and

     (2)  In consultation with the participating organizations, the Hawaii teacher standards board shall use and disburse the funds to the network partners in a manner that responds to the organizations' needs and circumstances while aiming to meet the purposes of this Act.

     The sums appropriated shall be expended by the Hawaii teacher standards board for the purposes of this Act.

     SECTION 5.  This Act shall take effect on July 1, 2009.
