A BILL FOR AN ACT


 

 

RELATING TO State OFFICERS.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  (a)  Notwithstanding any other provision of law to the contrary, for the period from July 1, 2009 to June 30, 2011, the salary paid to a state officer specified in subsection (b) shall be five per cent less than the annual salary amount that they would otherwise receive as provided for by law.

     (b)  For the purposes of this section, the term "state officer" means any of the following persons:

     (1)  The governor;

     (2)  The lieutenant governor;

     (3)  Members of the legislature;

     (4)  Justices and judges of all state courts;

     (5)  The administrative director of the State or an equivalent position; and

     (6)  Department heads or executive officers and the deputies or assistants to the department heads of the departments of:

         (A)  Accounting and general services;

         (B)  Agriculture;

         (C)  The attorney general;

         (D)  Budget and finance;

         (E)  Business, economic development, and tourism;

         (F)  Commerce and consumer affairs;

         (G)  Defense;

         (H)  Hawaiian home lands;

         (I)  Health;

         (J)  Human resources development;

         (K)  Human services;

         (L)  Labor and industrial relations;

         (M)  Land and natural resources;

         (N)  Public safety;

         (O)  Taxation; and

         (P)  Transportation;

          provided that the term shall not include the president of the University of Hawaii or the superintendent of education.

     SECTION 2.  In the event of a conflict between this Act and any other provision of law, this Act shall control.

     SECTION 3.  This Act shall take effect on July 1, 2009.
