A BILL FOR AN ACT


 

 

relating to agricultural land use.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 46, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§46-    Nonsignificant farm buildings.  (a)  Any law to the contrary notwithstanding, each county shall allow the construction of nonsignificant structures on land that is used for farming operations as defined in section 165-2, including greenhouses and sheds, without the requirement for a building permit.

     (b)  For purposes of this section, "nonsignificant structure" means a nonresidential dwelling structure that is a permitted use within the designated zoning of the land, does not cover more than        per cent or one thousand square feet of land, whichever is less, and does not exceed $       in total construction cost."

     SECTION 2.  New statutory material is underscored.


     SECTION 3.  This Act shall take effect on July 1, 2009.
