A BILL FOR AN ACT


 

 

relating to the department of education.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 302A, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§302A-    Excess lands and unused facilities; private development of long-term care facilities.  (a)  The department shall identify excess lands and unused school facilities under its control to be made available for the development of long-term care facilities.

     (b)  The department, through negotiation, may enter into contracts, leases, agreements, or other transactions with private developers for the development of any excess lands or unused facilities for the development of long-term care facilities, on terms as may be deemed appropriate by and with the concurrence of the director of finance.

     (c)  Any premiums, lease rents, or other remuneration the department receives from the contracts, leases, agreements, or other transactions pursuant to this section shall be retained by the department in the education design and construction project assessment fund.

     (d)  The department shall submit an annual report to the legislature twenty days prior to the convening of each regular session identifying and describing any contracts, leases, agreements, or transactions it has entered into pursuant to this section in the prior year.

(e)  For purposes of this section "long-term care facility" shall have the same meaning as section 349-21."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
