A BILL FOR AN ACT


 

 

relating to Maui north shore heritage park.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds it is in the best interest of the State and its residents to maintain the Maui north shore heritage park in an undeveloped state that would provide for access to public beaches and open spaces.  This initiative is supported by United States representative Mazie Hirono, the Democratic Party of Hawaii, the Maui Group of the Sierra Club, Hawaii Chapter, and the Maui General Plan Advisory Committee.

     The purpose of this Act is to require that the legacy land conservation commission prioritize consideration of the Maui north shore heritage park for acquisition by the department of land and natural resources. 

     SECTION 2.  (a)  The legislature declares that the lands described in this Act meet one or more of the criteria established under section 173A-2.6, Hawaii Revised Statutes.

     (b)  The legacy land conservation commission shall prioritize consideration of the Maui north shore heritage park for recommendation to the board of land and natural resources to acquire title to the Maui north shore heritage park.

     (c)  The Maui north shore heritage park consists of:

     (1)  Approximately forty-three acres described as tax map key II 3-8-01, parcel seventy-two, stretching from Kelaakai Place in Sprecklesville to the western boundary of H.P. Baldwin Park Road in Paia, which includes natural sand dunes, coastal beaches, and wetlands;

     (2)  Approximately seventeen acres known as H.P. Baldwin Park which is described as tax map key II 2-5-05, parcel forty-seven (4.6 acres) and parcel forty-six (12.5 acres);

     (3)  Approximately 4.5 acres of coastal lands stretching from the eastern border of H.P. Baldwin Park to the Paia Youth and Cultural Center which is described as tax map key II 2-6-01, parcel one (3.517 acres) and parcel four (1.08 acres);

     (4)  Approximately thirty-two acres described as tax map key II 2-5-05, parcel seventeen;

     (5)  Approximately 5.7 acres known as Lime Kiln Beach which is described as tax map key II 2-5-05, parcel fourteen; and

     (6)  Approximately twenty-six acres known as Stable Road Beach which is described as tax map key II 3-8-01, parcel three.

     SECTION 3.  This Act shall take effect upon its approval.
