A BILL FOR AN ACT


 

 

relating to service of process.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 634, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§634-     Service within a condominium or planned community.  (a)  Each board of directors of an association of apartment owners governed by chapter 514A or chapter 514B and the board of directors of a planned community association governed by chapter 421J shall designate a representative on the premises of the condominium or planned community who shall be authorized to provide entry to any duly appointed server of process and orders to allow the server to serve any summons, subpoena, notice, or order on any person within the condominium or planned community.

     (b)  The board of directors of an association of apartment owners or the board of directors of a planned community association shall register the name and address of its designated representative for purposes of this section on a form to be prescribed and prepared by the department of commerce and consumer affairs.

     (c)  The department of commerce and consumer affairs may adopt rules pursuant to chapter 91 to effect the purposes of this section."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
