A BILL FOR AN ACT


 

 

relating to legacy lands.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The purpose of this Act is to direct the board of land and natural resources to enter into negotiations and to acquire those lands along the Ka ‘Iwi coast that are in imminent danger of being developed.  The acquired land shall be held as resource value lands, also known as legacy lands.  The funds necessary for this acquisition shall come from the land conservation fund.

     SECTION 2.  Notwithstanding the acquisition and application provisions set forth in section 173A-5(h) and (i), Hawaii Revised Statutes, the board of land and natural resources shall enter into negotiations to acquire property along the Ka ‘Iwi coast, which is in imminent danger of being developed.  The board shall exercise its authority pursuant to section 173A-4, Hawaii Revised Statutes.

     SECTION 3.  There is appropriated out of the general revenues of the State of Hawaii the sum of $         or so much thereof as may be necessary for fiscal year 2009-2010 and the same sum or so much thereof for fiscal year 2010-2011 for deposit into the land conservation fund.

     SECTION 4.  There is appropriated out of the land conservation fund the sum of $         or so much thereof as may be necessary for fiscal year 2009-2010 and the same sum or so much thereof for fiscal year 2010-2011 to acquire certain property along the Ka ‘Iwi coast that is in imminent danger of being developed.

     The sums appropriated shall be expended by the board of land and natural resources for the purposes of this Act.

     SECTION 5.  The land acquired pursuant to this Act shall be held as resource value land, pursuant to the provisions of chapter 173A, Hawaii Revised Statutes.

     SECTION 6.  This Act shall take effect on July 1, 2009.
