A BILL FOR AN ACT


 

 

RELATING TO MARIJUANA.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Government reports and medical and social studies have consistently shown alcohol is a contributing factor in domestic violence, sexual assault, and other violent crime, as well as deaths caused by overdose.  In contrast, marijuana has never been indicated as a cause of violent behavior and there has never been a documented case of a marijuana overdose.

     Personal choices and public policies about marijuana should be based on scientific information and common sense rather than unjustified claims about the ill effects of the use of this substance. 

     The purpose of this Act is to authorize the personal possession and use of marijuana by a person twenty-one years of age or more in a private residence.

     SECTION 2.  Chapter 712, Hawaii Revised Statutes, is amended by adding a new section to part IV to be appropriately designated and to read as follows:

     "§712-      Authorized possession of marijuana.  Notwithstanding any law to the contrary, persons twenty-one years of age or older shall not be prosecuted, denied any right or privilege, nor be subject to criminal or civil penalties for the possession or use of not more than one ounce of marijuana in a private residence unless under court order prohibiting such possession or use.  As used in this section "marijuana" shall have the same meaning as "marijuana" and "marijuana concentrate" as provided in sections 329-1 and 712-1240."

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
